In support of his request, the applicant provides a letter from his medical provider. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is serving on active duty in the grade of staff sergeant (E-5). The applicant’s most recent FA results are as follows: Date Composite Score Rating 26 Jun 2013 87.20 Satisfactory 19 Dec 2012 87.67 Satisfactory 26 Sep 2012 62.70 Unsatisfactory 20 Mar 2012 78.10 Satisfactory 27 Dec 2012 43.00 Unsatisfactory 29 Jun 2011 85.40 Satisfactory 1 Mar 2011 43.10 Unsatisfactory 1 Dec 2010 47.70 Unsatisfactory The remaining relevant facts pertaining to this application are described in the letter prepared by the Air Force office of primary responsibility, which is included at Exhibit B. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends denial. DPSIM states the applicant provided a Medical Condition Determination for FA Test Failures issued by a medical provider indicating he in fact had a documented medical condition that precluded him from achieving a passing score in a non-exempt portion of the FA test, however; there is no evidence that his unit commander invalidated the FA. Air Force Instruction, 36-2905, Fitness Program, Air Force Guidance Memorandum (AFGM) 4, states that if the medical evaluation validates an illness or injury, the unit commander may invalidate the test results. There is no evidence of an error or injustice as the applicant did not provide any supporting documentation from the unit commander invalidating the test results. The complete DPSIM evaluation is at Exhibit B. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 31 Oct 2013 (Exhibit C) for review and comment within 30 days. As of this date, this office has not received a response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. ________________________________________________________________ THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2013-00219 in Executive Session on 17 Dec 2013, under the provisions of AFI 362603: , Panel Chair , Member , Member The following documentary evidence was considered: Exhibit A.  DD Form 149, dated 11 Feb 2013, w/atch.
