RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-00984 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: He be awarded the Air Force Outstanding Unit Award with Valor. ________________________________________________________________ _ APPLICANT CONTENDS THAT: He should have been awarded the contested award for his temporary duty assignment to DaNang, Vietnam, with the 13th Bombardment Squadron beginning 11 September 1996. In support of the applicant’s appeal, he provides documents extracted from his military personnel records and other documentation. The applicant's complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The applicant enlisted in the Regular Air Force on 29 November 1963. On 28 November 1967, the applicant was honorably released from active duty and transferred to the Air Force Reserve. He served 4 years on active duty and was credited with 1 year, 1 month and 17 days of foreign and/or sea service. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSID recommends denial. DPSID states the Air Force Outstanding Unit Award is awarded by the Secretary of the Air Force to numbered units that have distinguished themselves by exceptionally meritorious service or outstanding achievement that clearly sets the unit above and apart from similar units. The services include performance of exceptionally meritorious service, accomplishment of a specific outstanding achievement of national or international significance, combat operations against an armed enemy of the United States, or military operations involving conflict with or exposure to hostile actions by an opposing foreign force. A “V” device is awarded for combat or indirect combat support actions. The applicant’s dates of service with the 13th Bombardment Squadron were from 1 March 1966 to 20 January 1967 - rendering him ineligible for the Air Force Outstanding Unit Award with Valor awarded. The inclusive period for the award is 19 February 1965 to 19 February 1966. After a thorough review of the applicant’s master personnel record, they were able to verify award of the Presidential Unit Citation, Air Force Outstanding Unit Award, Air Force Longevity Service Award, Vietnam Service Medal with one Bronze Service Star, and the Republic of Vietnam Gallantry Cross with Palm should have been awarded during the applicant’s service from 29 November 1963 to 28 November 1967 and were not reflected in his records. Upon final board decision, administrative correction of the applicant’s record will be completed by AFPC/DPSOR. The DPSID complete evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 19 May 2013, a copy of the Air Force evaluation was forwarded to the applicant for review and response within 30 days (Exhibit D). As of this date, no response has been received by this office. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. The applicant’s contentions are duly noted; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted.
