RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-01079 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: His referral Enlisted Performance Report (EPR) with a close out date of 28 Jul 12 be removed from his records. ________________________________________________________________ _ APPLICANT CONTENDS THAT: It was later discovered that he had a medical condition that would have disqualified him from taking the run portion of the Fitness Assessment (FA) on 11 Jul 12. Had he been exempt from the cardio component of the FA, he would not have failed the FA test in question, thus would not have been given a referral EPR. In support of his request, the applicant provides copies of letters of support from the 10th Medical Group. His complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The applicant is currently serving on active duty in the Regular Air Force in the grade of senior airman. RATING PERIOD OVERALL PERFORMANCE ASSESSMENT * 28 Jul 12 4 28 Nov 11 4 28 Nov 10 5 *Contested Report The remaining relevant facts pertaining to this application are contained in the letters prepared by the appropriate offices of the Air Force, which is at Exhibit C and D. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSIM recommends denying removing the applicant’s FA test dated 11 Jul 12; however, they recommend exempting his cardio component of the FA test. In this respect, it was later determined by the applicant’s Primary Medical Care Provider that he had a medical condition that prevented him from passing the cardio component of the FA. The complete DPSIM evaluation, with attachment, is at Exhibit C. AFPC/DPSID recommends approving the applicant’s request to void the contested EPR from his records contingent upon the removal of the cardio portion of the FA test dated 11 Jul 12. In this respect, the applicant provided a memorandum dated 18 Jan 13 from his Primary Care Manager (PCM) that confirms his “medical condition may have impacted his ability to successfully complete the run portion of the FA which could have prevented him from passing the contested physical fitness examination”. Therefore, the FA failure was inappropriate for comment on the contested referral EPR. As a result, the referral EPR should be removed from his records. Additionally, they concur with the DPSIM recommendation regarding exempting applicant’s cardio component of the FA. The complete DPSID evaluation is at Exhibit D. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 13 Dec 13 for review and comment within 30 days. As of this date, this office has received no response. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice. Although the applicant did not request correction of his FA test, dated 11 Jul 12, we agree with the Air Force office of primary responsibility recommendation that the applicant should not have tested in the cardio component of the FA due to his medical condition. As a result, we believe the cardio component should be corrected to reflect “exempt” in the Air Force Fitness Management System (AFFMS). The recommended change will result in an overall composite fitness score of 88.50 (Satisfactory). Since his FA will result in a satisfactory score, his referral EPR rendered for the period of 29 Nov 11 thru 28 Jul 12 should be voided and removed from his records. Therefore, we recommend his records be corrected as indicated below. ________________________________________________________________ _ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that: a. The cardio component of the fitness assessment dated 11 July 2012 be amended to reflect “exempt” in the Air Force Fitness Management System. b.
