Air Force Good Conduct Medal with one Silver and one Bronze Oak Leaf Cluster (AFGCM w/1S&1BOLC) 2. Armed Forces Expeditionary Medal with four Bronze Service Stars (AFEM w/4BSS) 3. Small Arms Expert Marksmanship Medal with two Bronze Service Stars (SAEMR w/2BSS)) ________________________________________________________________ _ APPLICANT CONTENDS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, does not correctly reflect the requested awards. In support of his appeal, the applicant provides copies of his DD Form 214, National Personnel Records Center (NPRC) Transmittal, MSM w/1OLC Certificate, MSM Order, Service Medal Award Verification, Fact Sheet on KLM-SA, and Fact Sheet on KLM – Kuwait. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: The applicant is a former member of the Regular Air Force who served from 11 December 1974 to 31 December 1995. He retired effective 1 January 1996 in the grade of master sergeant (E-7) after serving 21 years and 20 days on active duty, with 4 years, 5 months, and 7 days of Foreign Service. The remaining relevant facts, extracted from the applicant’s military service record, are contained in the evaluation provided by the Air Force office of primary responsibility at Exhibit C. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSID recommends denying the applicant’s requests for the AFGCM w/1S&1BOLCs, SAEMR w/2BSS, and the AFEM w/4BSS. DPSID indicates that after a thorough review of the applicant’s official military personnel record and the provided documentation, they were able to verify award of the MSM w/1BOLC, NCOPMEGR w/2BOLC, and the KLM-SA. DPSID states the applicant’s records indicate he received an Article 15, under the provisions of the Uniform Code of Military Justice (UCMJ) on 8 January 1979, causing his new award period for the AFGCM to begin on 9 January 1979 with the time between the end of his inclusive period for his first AFGCM and his new award to be not credible for award of the AFGCM. The applicant’s DD Form 214 indicates he qualified as an expert marksman with both the rifle and pistol; however, there is no provision for additional service stars for the SAEMR. Therefore, his DD Form 214 is correct in regard to his award of the SAEMR w/1BSS. The applicant’s DD Form 214 reflects award of the AFEM w/2BSS. Their office was unable to locate official documentation in his records verifying he participated in two additional operations to make him eligible for award of the AFEM w/4BSS. The complete DPSID evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 19 May 2013 for review and response within 30 days (Exhibit D). As of this date, this office has received no response. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to do so. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice in regard to the applicant’s request for award of the AFGCM w/1S & 1BOLC, AFEM w/4BSS, and the SAEMR w/2BSS. We took careful notice of the applicant’s complete submission in judging the merits of the case and find that he has not provided any documentary evidence to substantiate his claim that he meets the criteria for these awards. Therefore, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that relief beyond that already administratively granted is not warranted.
