RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-02462 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: The Fitness Assessment (FA), dated 13 Mar 13 be declared void and removed from the Air Force Fitness Management System (AFFMS). ________________________________________________________________ APPLICANT CONTENDS THAT: He had a medical condition, specifically abdominal pain, which occurred during the contested FA and precluded him from obtaining an overall satisfactory rating. The medical condition has been validated through two memoranda from his medical provider indicating he sustained an injury during his FA, which caused abdominal pain in the right lower abdomen. The applicant’s complete submission, with attachments, is at Exhibit A. _______________________________________________________________ STATEMENT OF FACTS: The applicant was serving in the Regular Air Force in the grade of Staff Sergeant (E-5) at the time of the contested FA. On 13 Mar 13 the applicant participated in the contested FA and obtained an overall “Unsatisfactory” score of 73.70. Additionally, the applicant only completed 36 of the 42 minimum required “Sit-ups” for males under 30. On 14 Mar 13, the applicant provided a DD FM 6889, Individual Sick Slip, placing him on bed rest from 14 Mar 13 to 15 Mar 13. On 15 Mar 13, he was seen at the San Antonio Military Medical Center (SAMMC) and diagnosed with constipation/abdominal pain. On 21 Mar 13, a memorandum from the applicant’s medical provider at SAMMC, states he was under his physicians care, with clinic visits on 14 and 21 Mar 13 and currently under a medical evaluation that precludes his ability to perform Physical Training (PT). On 21 Mar 13, a memorandum from the 359th MDG/MDOS, indicates the applicant sustained “Abdominal pain in the right lower abdomen” during the contested FA. In the finding the medical provider recommends “No change to the member’s current medical clearance limitations is warranted and I feel he will be able to successfully pass if he is able to retest in 7-10 days, if symptoms have resolved.” IAW AFI 36-2905; Atch 1, Para 10, “If an Airman becomes injured or ill during the FA and is unable to complete all required components, he/she will have the option of being evaluated at the Medical Treatment Facility (MTF) but his/her test will still count unless rendered invalid by the Unit Commander.” Atch 1, Para 10a, “If the medical evaluation validates the illness/injury, the Unit Commander may invalidate the test results;” Para 2.12.3., “If a member is unable to complete any required portion of the AF Fitness Program (e.g., FA, FIP session, intervention classes), the member must receive written waiver/approval (Table 4.3.) from the Unit CC.” The applicant’s last 5 FA results are as follows: Date Composite Score Sit-ups Rating 10 Jun 2013 92.70 64 Excellent *13 Mar 2013 73.70 36 Unsatisfactory 12 Apr 2012 91.60 53 Excellent 20 Oct 2011 88.70 51 Satisfactory 13 Apr 2011 89.70 59 Satisfactory *Contested FA _______________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSIM recommends approval of the applicant’s request to remove the FA dated 13 Mar 13, stating “it is apparent the applicant’s ability to complete the FA was hindered by an illness/injury.” DPSIM references, AFI 36-2905, Fitness Program, Paragraph 10: "If an Airman becomes injured or ill during the FA and is unable to complete all required components, he/she will have the option of being evaluated at the Medical Treatment Facility (MTF) but his/her test will still count unless rendered invalid by the Unit Commander." While there is no evidence that the commander invalidated the results, based on the evidence, they conclude the applicant had a medical condition that presented itself during the FA. Specifically the statements provided from both his health care provider and SAMMC validate injury/illness. A complete copy of the AFPC/DPSIM evaluation, with attachment, is at Exhibit B. _______________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation, with attachment, was forwarded to the applicant on 20 Sep 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit C). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After thoroughly reviewing the evidence of record and noting the applicant’s contentions, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the contested FA should be declared void. Although the applicant has not provided a letter from his commander invalidating the FA, he has provided two statements from his medical provider and the San Antonio Military Medical Center who clearly indicate that he had an illness during the contested FA. Additionally, the applicant provided an “Individual Sick Slip” and medical documents which indicates he had abdominal pain and underwent a medical procedure to remedy his condition. Given the evidence, it is apparent the applicant’s ability to complete the FA was hindered by an illness/injury. In view of this and noting that other than the contested FA, his FA history reflects that he has never previously scored less than 50 sit-ups and has scored “Satisfactory” or “Excellent” on all FAs to date, we find a totality of the evidence supports favorable consideration of this request.
