RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03652 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected as follows: Item 7a, Place of Entry (POE) into Active Duty, be changed from Benton, IL to Laughlin, TX; Item 7b, Home of Record (HOR) at time of Entry, be changed from Benton, IL to Laughlin, TX. APPLICANT CONTENDS THAT: On 1 June 1983, he entered active duty at Laughlin AFB, TX after graduation from the US Air Force Academy (USAFA). The applicant states that he discovered the error in a recent VA Mortgage Loan transaction in which the financial institution stated his entry into active duty should be corrected to reflect Laughlin AFB, Texas 78843 as a result of the first active duty assignment listed under military education. In support of his request the applicant provides copies of his DD Form 214, AF Form 475, Education/Training Report and AF Form 1887, Request and Authorization for Aeronautical Orders. His complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant served in the Regular Air Force from 1 June 1983 to 14 December 1990. He served for a period of 7 years, 6 months and 14 days of active service. THE AIR FORCE EVALUATION: DPSIPS recommends denial. After a thorough review of the applicant's military personnel record and other supporting documentation, there appears to be no error or injustice regarding the applicant’s HOR and POE. Joint Federal Travel Regulation Volume I, Appendix A, states in part that a HOR is the place recorded as the individual’s home when commissioned, appointed, enlisted, inducted, or ordered into a tour of active duty. Any correction must be fully justified and the home, as corrected, must be the member’s actual home upon entering the Service, and not a different place selected for the member's convenience. The applicant's Extended Active Duty Order, DD Form 214, and AF Form 100, Request and Authorization for Separation, list his HOR as Benton, IL. The AF Form 475 and AF Form 1887 list the first duty station of Laughlin AFB, TX, not the HOR; therefore, they are not considered in this determination. The member attended the USAFA, Colorado Springs which is deemed as his original POE. The complete DPSIPS evaluation, with attachment is at Exhibit C. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 6 December 2013, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application. ?
