RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-03746 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect he was awarded the National Defense Service Medal. ________________________________________________________________ APPLICANT CONTENDS THAT: He served in the Air Force Reserves from 14 March 1990 through 13 September 1990 and on active duty from 13 August 1990 to 24 August 1990. In support of his appeal, the applicant submits his DD Form 214s, AF Form 938, Request and Authorization for Active Duty Training/Active Duty Tour and his Reserve Orders. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: The applicant is a former member of the Air Force Reserves with active duty dates of 20 March 1986 to 13 March 1990 and from 9 April 1999 to 27 April 1999. A review of the applicant’s records verified he is entitled to the award of the Air Force Longevity Service Medal and the Non- Commissioned Officer Professional Military Education Graduate Ribbon. His records will be updated accordingly, upon final Board action. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPSID recommends denial. The National Defense Service Medal is awarded for honorable service as a member of the Armed Forces of the United States for any period between 26 June 1950 and 27 July 1954, or between 1 January 1961 and 14 August 1974. During those periods, service members in the following categories shall not be eligible for the National Defense Service Medal; members of the Guard or Reserve forces on short tours of active duty to fulfill training obligations under an inactive duty training program; any service members on temporary duty or temporary additional duty to serve on boards, courts, commissions or similar organizations; any service member on active duty for the sole purpose of undergoing a physical examination. The National Defense Service Medal is also awarded for honorable service as a member of the Armed Forces of the United States for any period between 2 august 1990 and 30 November 1995. Service members on active duty, members of the Selected Reserves in good standing and members of other than the Selected Reserve who were called to active duty shall also be eligible. During that period service members in the following categories shall not be considered eligible: any service member on active duty for the sole purpose of undergoing a physical examination, or any member of the Individual Ready Reserve, the Inactive National Guard or the standby or Retired Reserve whose active duty service was for training only, or to serve on boards, courts, commissions and similar organizations. The applicant did not serve during a timeframe in which the National Service Defense Medal was authorized rendering him ineligible for the award. To grant him relief would be contrary to the eligibility criteria established by DoDM 1348.33, the Secretary of the Air Force Chief of Staff and/or the War Department. The complete DPSID evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 10 January 2014, for review and comment within 30 days (Exhibit D). As of this date, this office has received no response. ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the available evidence of record and the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the AFPC/DPSID and adopt its rationale as the basis for our conclusion that the applicant has not provided sufficient evidence to support his request.
