RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-04814 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The following corrections be made to her DD Form 214, Certificate of Release or Discharge from Active Duty: a. Item 13, Decorations, Medals, Badges, Citations and Campaign Ribbons awarded or Authorized (All periods of service); be amended to include the Global War on Terrorism Expeditionary Medal. b. Item 18, Remarks, be amended to include her service in Kuwait during Operation DESERT STORM. APPLICANT CONTENDS THAT: She served in Kuwait during Operation DESERT STORM from 1990 to 1991. The applicant believes the Board should find it in the interest of justice to consider her untimely application because she did not realize the omission of her DESERT STORM service until she applied for a State bonus. In support of her request, the applicant provides a copy of her DD Form 214, Certificate of Release or Discharge from Active Duty. Her complete submission, with attachment, is at Exhibit A. STATEMENT OF FACTS: The applicant served in the Regular Air Force from 27 January 1989 through 15 March 1991. Her DD Form 214 reflects “00 years, 00 months and 00 days” of Foreign Service. AIR FORCE EVALUATION: AFPC/DPAPP recommends denial of the applicant’s request for Foreign Service in Kuwait. A review of her master personnel records failed to provide any documents to substantiate her service in Kuwait. The complete DPAPP evaluation is at Exhibit C. AFPC/DPSID recommends denial of the applicant’s request for award of the Global War on Terrorism Expeditionary Medal. Although she requests the medal be added to her record, they presume her request is actually for the Southwest Asia Service Medal, which is the appropriate award authorized for direct support of Operation DESERT STORM. The Global War on Terrorism Expeditionary Medal was established by Executive Order 13289. Individuals must have deployed abroad for service in Global War of Terrorism operations on or after 11 September 2001 to a future date to be determined by the Secretary of Defense. Service members must have been permanently assigned, attached, or detailed to a unit that participated in designated operations in the specified area of eligibility for 30 consecutive days or 60 non-consecutive days, or meet one of the following criteria: was engaged in actual combat against the enemy and under circumstances involving grave danger of death or serious bodily injury from enemy action, regardless of time in the area of eligibility. While participating in the designated operation, regardless of time in the area of eligibility, was killed, wounded, or injured requiring medical evacuation from the area of eligibility. Service members participating as regularly assigned aircrew members flying sorties into, out of, within, or over the area of eligibility in direct support of Global War on Terrorism Expeditionary Medal approved operations are eligible for the medal. Each day that one or more sorties are flown in accordance with these criteria shall count as one day toward the 30 consecutive or 60 non-consecutive day requirement. The Southwest Asia Service Medal, authorized by Executive Order 12754, 12 March 1991, is awarded to members of the United States Armed Forces who served in support of Operations DESERT SHIELD or DESERT STORM, between the period 2 August 1990 and 30 November 1995, in one or more of the following areas: Persian Gulf, Red Sea, Gulf of Oman, Gulf of Aden, that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude, and the land areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and the United Arab Emirates, or individuals serving in Egypt, Israel, Turkey, Syria and Jordan (including territorial airspace and water) directly supporting combat operations between 17 January 1991 and 30 November 1995. To be eligible, a service member must: be permanently assigned, attached, or detailed for one or more days with an organization participating in ground and/or shore (military) operations; be permanently assigned, attached, or detailed for one or more days aboard a naval vessel directly supporting military operations; have actually participated as a crew member in one or more aerial flights directly supporting military operations in the areas designated; have served on temporary duty for 30 consecutive days or 60 non-consecutive days. Those time limitations may be waived for people participating in actual combat operations. The applicant's service dates were prior to the award dates for the Global War on Terrorism Expeditionary Medal; therefore, rendering her ineligible. Although her records include a travel order for deployment in support of Operation DESERT SHIELD, the order is for a deployment within the continental United States and not to the area of eligibility. Therefore, she is also ineligible for the Southwest Asia Service Medal. To grant the applicant relief would be contrary to the eligibility criteria established by DoD Manual 1348.33, Manual of Military Decorations and Awards. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 18 April 2014 copies of the Air Force evaluations were forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit E). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
