RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-04965 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her AF Form 1089, Leave Settlement Option, be amended to reflect that she elected to carry forward all of her accrued leave into her next enlistment. APPLICANT CONTENDS THAT: She is aware that she initialed next to a check mark on the AF Form 1089 and provided a signature; however, there are two mitigating circumstances that contributed to this error. First, the Dyess Air Force Base (AFB) Military Personnel Flight (MPF) reenlistment section used an internal document to process her reenlistments along with the AF Form 1089. While both documents contain the same information, the order of elections regarding disposition of leave balance is different on each. As such, this difference caused some confusion on her part. Secondly, when processing her reenlistment, she had to scan both forms to the reenlistment section for processing. There seemed to be no internal quality control measures to check for such an error. In fact, the reenlistment section could have processed her request by only using the worksheet and not sending both forms to the finance office for processing. The finance office was also unable to provide a quality control measure or see the mismatch information on the forms. Based upon these facts she respectfully requests reconsideration and reinstatement of her 41 days of leave. In support of her request, the applicant provides a personal statement and copies of her reenlistment worksheet, AF Form 1089, and DD Form 4/1, Enlistment/Reenlistment Document Armed Force of the United States. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Regular Air Force in the grade of Staff Sergeant (SSgt), E-5. The remaining relevant facts pertaining to this application are contained in the letter prepared by the appropriate office of the Air Force at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOA recommends denial. DPSOA states the applicant reenlisted on 28 May 2013 for 4 years and 3 months. She marked on the Reenlistment Worksheet used by the Military Personnel Flight (MPF) “I elect to carry forward all of my accrued leave into my next enlistment.” When she completed her AF Form 1089, she marked “Cash settlement for all of my accrued leave” which was 41 days at the time of her reenlistment. The applicant contends she always wanted to carry forward all of her accrued leave and inadvertently marked the wrong box on the AF Form 1089. Additionally, she contends the MPF should have noticed the discrepancy between the two forms. However, the applicant clearly marked the AF Form 1089, which states in all caps to receive a cash settlement for all accrued leave. The complete AFPC/DPSOA evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 27 June 2014, for review and comment within 30 days (Exhibit D). To date, a response has not been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice to warrant relief. Having carefully reviewed the applicant’s submission and the evidence of record, we are persuaded that relief is warranted in this case. We note that the Air Force office of primary responsibility has reviewed the applicant’s request and recommends denial; however, we are persuaded that it is not unreasonable to believe that the use of the two differing forms to process her reenlistment could cause a misinterpretation in the processing of the applicant’s leave settlement. We note the applicant has stated her understanding that the requested correction will entail recoupment. Accordingly, we recommend her records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that her AF Form 1089, Leave Settlement Option, dated 10 May 2013, is amended in item II, Leave Settlement on Reenlistment, to reflect that she elected option “B” Carry Forward All of My Accrued Leave, and that she be subject to recoupment for the previous leave settlement.
