RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05081 COUNSEL: NONE XXXXXXXXXX HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be permitted to initiate a new two year contact for Aviator Continuation Pay (ACP) for Fiscal Year (FY) 2012 for the period 24 May 2012 through 23 May 2014. APPLICANT CONTENDS THAT: On 29 August 2013, the Air Force Board for Correction of Military Records (AFBCMR) changed the effective dates of his FY 2010 ACP contract to 24 May 2010 through 3 May 2012. This change makes him eligible for a two year contract for the period 24 May 2012 through 23 May 2014. In support of his request, the applicant provides copies of the AFBCMR directive and associated documentation, approved FY 2010 ACP contract, orders and various other items related to his request. His complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to Special Order A-V000059 dated 6 March 2012, the applicant was ordered to active duty on 1 February 2012 through 31 May 2017. In a memorandum dated 24 February 2012, the Air Force implemented the FY12 ACP program for the Active Duty, Air National Guard and Air Force Reserves. On 28 August 2013, the applicant’s AFBCMR request that he be allowed to initiate a 2010 ACP agreement for the period 24 May 2010 through 23 May 2012 was approved at a rate of $15,000 per year. AIR FORCE EVALUATION: NGB/A1PF recommends approval. According to Special Order AV- 000059 [sic] dated 6 March 2012, the applicant was ordered to duty from 1 February 2012 through 31 May 2017. This period of service would have allowed him to enter into a FY 2012 ACP agreement effective 24 May 2012 through 23 May 2014 at a rate of $15,000 per year. The applicant was delayed from applying for the FY 2012 ACP Agreement pending final AFBCMR results relating to a previous ACP agreement covering the period 24 May 2010 through 23 May 2012. On 29 August 2013, he received notification from the AFBCMR that his request to enter into the FY 2010 ACP contract was approved, which in turn would have allowed him to apply for the FY 2012 ACP Agreement. Notwithstanding the delay awaiting AFBCMR results, the applicant met all other eligibility requirements. The complete A1PF evaluation, with attachments, is at Exhibit C. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 10 January 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting corrective action. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant's records be corrected as set forth below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that competent authority approved his request for an Aviator Continuation Pay agreement for the period 24 May 2012 through 23 May 2014, at a rate of $15,000 annually, under the Air National Guard Fiscal Year 2012 Aviator Continuation Pay program. ?
