RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05099 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect award of the Afghanistan Campaign Medal (ACM). APPLICANT CONTENDS THAT: He was not awarded the ACM for the time he served in Pakistan in support of Operation ENDURING FREEDOM (OEF). In support of his request, the applicant provides a copy of his DD Form 214, Certificate of Release or Discharge from Active Duty, deployment orders to Pakistan, and a travel voucher summary for the deployment to Pakistan. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The DD Form 214, Certificate of Release or Discharge from Active Duty, issued in conjunction with his 1 Jan 05 retirement, reflects 6 years, 10 months, and 14 days of foreign service.On 28 Feb 14, AFPC/DPSID was able to verify the applicant’s entitlement to the Air Force Expeditionary Service Ribbon with Gold Border (AFESR w/GB), the Global War On Terrorism Service Medal (GWOT-S), and the Global War On Terrorism Expeditionary Medal (GWOT-E). AIR FORCE EVALUATION: AFPC/DPSID recommends denial, indicating there is no evidence of an error or an injustice. The applicant’s deployment to Pakistan does not make him eligible for the ACM as Pakistan is not in the Area of Eligibility (AOE). The complete DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 14 Mar 14 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant correcting the applicant’s records to show with entitlement to the ACM. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. We note the OPR has determined the applicant’s eligibility for the AFESR w/GB, the GWOT-S, and the GWOT-E and will correct his records administratively. Therefore, in the absence of evidence the applicant was in the AOE, we find no basis to recommend granting his request for the ACM. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
