RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05275 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Home of Record (HOR) be changed from Yokota AB, Japan to Tinker AFB, OK. APPLICANT CONTENDS THAT: At the time of his enlistment, he was a dependent living with his father in Japan and his HOR was accidentally listed as a P.O. Box at Yokota AB. He is applying for leave and according to the continuous overseas tour policy the government will only pay to send him to his HOR. He has no ties to Japan and has no desire to return there after he leaves the military. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 7 Dec 11, the applicant reenlisted in the grade of Staff Sergeant (SSgt). The applicant’s DD Form 4, reflects PSC 78, Box 3104, APO AP, as the HOR. The Joint Travel Regulation (JTR), para U7200, and AFI 36-3003, Military Leave Program, para 14, Unique Leave Provision, states members can request travel to an alternate authorized place through their respective commander to AFPC/DPSIMC for approval. AIR FORCE EVALUATION: AFPC/DPSIPE recommends denial. There is no evidence of an error or justification that warrants a change to the official record. DD Form 4, Enlistment/Reenlistment Document Armed Forces of the United States, is the source document for HOR and Place of Entry (POE). The Joint Federal Travel Regulations (JFTR) for Uniformed Service, Volume 1, Appendix A1, part 1 states the HOR is, "The place recorded as the individual's home when reinstated, reappointed, or reenlisted, and remains the same as that recorded when commissioned, appointed, enlisted, inducted, or ordered into a tour of active duty unless there is a break in service of more than one full day. Only if a break in service exceeds one full day may the member change the HOR." The HOR is the location identified by the individual upon entering the service, not a location where the individual is later assigned or a location selected for convenience; a correction must be fully justified. Domicile or legal residency may change, but the HOR will not. AFPC Enlisted Accessions Branch confirmed that the applicant's initial DD Form 4/1, dated 16 Aug 06, as well as subsequent enlistment documents list PSC 78 Box 3104, APO AP, 96326 as his HOR. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 12 Sep 14 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The applicant was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant changing his HOR. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. It appears the applicant is attempting to change his HOR so he can take Consecutive Overseas Tour (COT) leave in the states. Therefore, it is suggested that he apply for relief under the provisions of the JTR and AFI 36-3003, Military Leave Program noted above. In view of the above and in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified that the evidence presented did not demonstrate the existence of an error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
