RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05363 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. The Meritorious Service Medal (MSM) be added to her DD Form 214, Certificate of Release or Discharge from Active Duty. 2. The Air Force Commendation Medal (AFCM) with one Bronze Oak Leaf Cluster (AFCM w/1BOLC) be added to her DD Form 214. (Administratively Corrected) 3. The Southwest Asia Medal (SWASM) be added to her DD Form 214. (Administratively Corrected) APPLICANT CONTENDS THAT: She was awarded the aforementioned medals; however, they are not reflected on her DD Form 214. The applicant believes that the Board should find it in the interest of justice to consider her untimely application because she is seeking government employment and the inclusion of the aforesaid medals will allow her to gain “veterans’ points.” In support of her request, the applicant provides copies of her DD Form 214 and citations for the AFCM w/ 1BOLC and MSM. The applicant's complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant served in the Regular Air Force from 3 November 1981 to 11 December 1991 for a total of 10 years, 1 month and 11 days of active duty. AIR FORCE EVALUATION: AFPC/DPSID recommends approval of the applicant’s request to add the MSM to her DD Form 214. While they are unable to locate a special order verifying award of the MSM, the applicant provided a signed certificate for award of the MSM with an inclusive period of 22 July 1988 to 30 December 1991, and a “Given Under My Hand” date of 6 January 1992. Although the inclusive dates of the award do not coincide with the applicant’s Date of Separation (DOS), DPSID located AF Form 973, Request and Authorization for Change of Administrative Orders, amending her DOS from 30 December 1991 to 11 December 1991 which accounts for the discrepancy of the award inclusive dates. Should the Board approve the applicant’s request; a special order will be accomplished so that the applicant's record can be updated. In addition, the MSM citation and certificate will be corrected to accurately reflect her DOS of 11 December 1991. Notwithstanding the above, DPSID was able to verify the applicant's entitlement to the AFCM w/1BOLC, the Air Force Outstanding Unit Award w/3BOLC, the SWASM with two Bronze Service Stars, the Kuwait Liberation Medal-Saudi Arabia and the Kuwait Liberation Medal-Kuwait. Upon the final Board decision, administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 14 March 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting relief. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, in addition to the administrative corrections to add the AFCM and the SWASM to his record, we recommend the applicant's records be corrected as set forth below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that the DD Form 214, Certificate of Release or Discharge from Active Duty, issued in conjunction with her 11 December 1991 discharge, be amended in Block 13, Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized (All Periods of Service), to reflect the Meritorious Service Medal.
