RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05524 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His duty history be amended to reflect “Deputy Commander, 92nd Mission Support Group (MSG)” rather than “Deputy Commander, 92nd Logistics Readiness Squadron (LRS).” APPLICANT CONTENDS THAT: While he was not directly assigned to the MSG, and his duty history reflects he served as the Deputy Commander for the LRS, he served as the Deputy Commander for the MSG for several months before his move to the US European Command. Furthermore, the LRS does not have a Deputy Commander position. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving on active duty in the grade of lieutenant colonel (O-5). The applicant’s duty history during the period in question, as reflected in the Military Personnel Data System (MilPDS), is as follows: EFFECTIVE DATE ORG DUTY TITLE 28 Aug 06 92nd LRS Director, Air Exped Force Cell *14 May 08 92nd LRS Deputy Commander 27 Sep 08 AFELM Joint Logistics Planner *contested duty title The applicant’s performance report rendered for the period 26 Aug 07 through 10 Sep 08 reflects he was assigned to the 92nd LRS with duty at the 92nd MSG as Deputy Commander. The Overall Rater Assessment by the then MSG commander includes the following bullet: “Incredible...period! Seamless leadership in my absence; handpicked for tough EUCOM J3/5 job...follow w/SDE!” The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPALL recommends denial indicating there is no evidence of an error or an injustice. The applicant was assigned to the 92nd LRS from 3 Aug 05 through 27 Sep 08 and served as the acting commander for six months while the commander was deployed. He also performed duties at the MSG from Aug 06 through Sep 08. In order to be released for a deputy commander position in the 21R (Logistics Readiness Officer) career field, a service member must be a graduated squadron commander who has completed senior development education (SDE). The applicant did not meet these requirements during the reporting period in question and there is no record of him being hired for the position. However, if the decision is to grant the relief sought, the records should be corrected to show the duty title of "Interim Deputy Commander, 92 Mission Support Group" for the duration of his attachment to the 92nd Mission Support Group, Fairchild AFB, 14 May 08 to 27 Sep 08. A complete copy of the AFPC/DPALL evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Jun 14 for review and comment within 30 days (Exhibit C). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an injustice warranting partial relief. The applicant contends during his assignment with the 92nd Logistics Readiness Squadron he served as the deputy commander for the Mission Support Group for several months during the period 26 Aug 07 through 10 Sep 08 and his duty history should therefore be changed accordingly. While we note the comments of AFPC/DPALL indicating that the applicant was not qualified to serve as a permanent deputy commander position in his career field as he was not a graduated squadron commander who had completed senior development education (SDE), we believe some measure of relief is warranted. In this respect, we note the applicant’s performance report for the period 26 Aug 07 thru 10 Sep 08, indicates that he provided “seamless leadership” during the commander’s absence, therefore, while we don’t disagree with the determination of the OPR that the applicant was not qualified to hold the permanent position of Deputy Mission Support Group Commander, we believe it would be appropriate to correct the applicant’s records to reflect that he served as the interim deputy mission support group commander as noted in his officer performance report during the group commander’s absence. Therefore, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show his duty title, effective 14 May 2008, as reflected in his duty history in the Military Personnel Data System (MilPDS), be corrected to reflect “Interim Deputy Commander, 92nd Mission Support Group, Fairchild AFB.
