RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2013-05574 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: His records be corrected to reflect he served in Thailand. ________________________________________________________________ APPLICANT CONTENDS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, does not reflect his combat zone duty. In support of his request, the applicant provides a copy of a handwritten note indicating the dates and times of flights and missions he performed. The applicant’s complete submission, with attachment, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: On 18 Oct 63, the applicant enlisted in the Regular Air Force. On 17 Oct 67, the applicant was released from active duty upon completion of required active duty time and was credited with 4 years of total active service, including 6 months and 13 days of foreign service. ________________________________________________________________ AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. DPAPP states the applicant failed to provide any documents that substantiate foreign service time in Thailand. The DPAPP evaluation is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant provided a written statement indicating that he was in Thailand from 4 Oct 66 to 26 Oct 66. His statement included specific details about his stay in Thailand to include where he was billeted, last name of bunkmate, purpose of mission, and other various pieces of information. The applicant complete submission is at Exhibit E. ________________________________________________________________ FINDINGS AND CONCLUSIONS OF THE BOARD: After careful consideration of applicant’s request and the evidence of record, we find the application untimely. The applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. The applicant has not shown a sufficient reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the untimely filing of this application. ________________________________________________________________ DECISION OF THE BOARD: The application was not timely filed and it would not be in the interest of justice to waive the untimeliness.
