RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-00460 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect that he was awarded Air Force Commendation Medal (AFCM) and the Air Force Overseas Short Tour (AFOR-ST) Ribbon. APPLICANT CONTENDS THAT: He should have received the requested awards. His records were lost in a fire, which is in no way is his fault. He shows proof from his DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, that he was overseas and a letter of commendation from his commander. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 2 Mar 53. On 1 Mar 57, the applicant was furnished an honorable discharge, and was credited with four years of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial for award of the AFCM, indicating there is no evidence of an error or injustice. Per Army Regulation 600-45, the policy in effect at the time of the applicant’s service, members in possession of letters of commendation signed by a Major General occupying the position of a Major General between 7 Dec 41 and 1 Jan 46 can make an application to receive the AFCM. However, the date on the applicant’s letter of commendation falls outside of the dates when a letter of commendation could be converted to an AFCM; therefore, he is ineligible. The applicant has also not provided any official documentation to verify he was recommended for the medal. As for his request for the AFOR-ST, the AFOR was authorized on 12 Oct 80 and is awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Only individuals serving on active duty as of 6 Jan 86 are eligible to earn the AFOR for overseas tours performed prior to the 1 Sep 80 implementation date. However, because the applicant’s service was many years prior to the implementation date of the AFOR, and he did not serve on active duty on or after 6 Jan 86, he is ineligible for the award. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 28 Jul 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
