RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-00919 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Certificate of Release of Discharge from Active Duty be updated to reflect “Operation DESERT STORM/SHIELD campaign badge Was Authorized” and he receive an updated DD Form 214. APPLICANT CONTENDS THAT: His DD Form 214 should be updated in Block 13 or 18 to reflect that he served during Operation DESERT STORM/SHIELD when a campaign badge was authorized. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 5 Jun 96, the applicant entered the Regular Air Force The applicant’s DD Form 214, reflects that he served from 6 Jun 96 to 1 Apr 97 in support of Operation DESERT STORM/SHIELD. On 10 Apr 97, the applicant received a general (under honorable conditions) discharge. He was credited with 10 months and 6 days of active service. AIR FORCE EVALUATION: AFPC/DPSIM states they cannot make a determination as to whether the applicant should or should not be awarded the Campaign Badge for Operation DESERT STORM/SHIELD. They are not the proper approving authority for campaign badges; rather the Awards and Decoration Branch should be contacted. The complete DPSIM evaluation is at Exhibit B. AFPC/DPSOR recommends denial of the applicant’s request to have an Operation DESERT STORM/SHIELD Campaign Badge included on his DD Form 214, Certificate of Release or Discharge from Active Duty, indicating he failed to provide evidence the DD Form 214 was prepared in error. The governing directive for the DD Form 214 is AFI 36-3202, Separation Documents. It authorizes the listing of decorations, unit awards, badges and service awards that are authorized for wear in uniform by Air Force members. There is not an Operation DESERT STORM/SHIELD Campaign Badge authorized in the inventory for wear by active Air Force personnel. The complete DPSOR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: He states he is not requesting to obtain a Campaign Badge for Operation DESERT STORM/SHIELD, but is requesting the comments/remarks on his DD Form 214, be updated to reflect that he served in Support of Operation DESERT STORM/SHIELD during a time when a campaign badge was authorized. He is not requesting a Campaign Badge that is not authorized for wear. The applicant’s complete submission, with attachments, is at Exhibit E. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We note that DPSOR recommends denial for award of a campaign badge. However, we note that the applicant is actually requesting that his DD Form 214 be amended to include a statement that he served in support of Operation DESERT STORM/SHIELD during a time when a campaign badge was authorized. After thoroughly reviewing the applicant’s appeal, we find no error or injustice in the way his DD Form 214 was prepared. Therefore, we conclude the applicant has failed to provide any evidence showing that he has been the victim of an error or injustice. In view of the above and in the absence of evidence to the contrary, we find no basis upon which to favorably consider this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
