RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01046 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the following awards and decorations: Kuwait Liberation Medal-Saudi Arabia (KLM-SA) Kuwait Liberation Medal-Kuwait (KLM-K) Southwest Asia Service Medal with three Bronze Service Stars (SWASM, w/3 BSSs). APPLICANT CONTENDS THAT: The KLM-SA, KLM-K and the SWASM, w/3 BSSs are missing from his DD Form 214, Certificate of Release or Discharge from Active Duty. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 21 Aug 83, the applicant entered the Regular Air Force. On 4 Jan 91, he was ordered to proceed on a temporary duty assignment for approximately 179 days to a classified location in support of Operation DESERT SHIELD. On 20 Aug 93, the applicant was honorably discharge. AIR FORCE EVALUATION: AFPC/DPSID recommends approval for award of the KLM-SA, KLM-K and the SWASM w/2 BSSs. The KLM-SA is awarded members who participated in Operation DESERT STORM, and the Liberation of Kuwait. Military personnel must have served between 17 Jan 91 and 28 Feb 91 in one or more of the following areas: the Persian Gulf, Red Sea; Gulf of Oman; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden, or, the total land area of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and United Arab Emirates. The KLM-K is awarded to members who participated in Operations DESERT SHIELD/DESERT STORM, and the Liberation of Kuwait. Military personnel must have served between 2 Aug 90 and 31 Aug 93, in one or more of the following areas: the Persian Gulf, Red Sea; Gulf of Oman; that portion of the Arabian Sea that lies north of 10 degrees north latitude and west of 68 degrees east longitude; Gulf of Aden, or, the total land area of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar and United Arab Emirates. The SWASM is awarded to members of the United States Armed Forces who served in support of Operations DESERT SHIELD or DESERT STORM in one or more of the following areas from 2 Aug 90 to 30 Nov 95: the Persian Gulf, Red Sea, Gulf of Oman, Gulf of Aden, that portion of the Arabian Sea that lies north of 100 N. Latitude and west 680 E. Longitude, as well as the total areas of Iraq, Kuwait, Saudi Arabia, Oman, Bahrain, Qatar, and the United Arab Emirates. The applicant’s AF Form 910, Enlisted Performance Report (AB Thru TSGT), for the period 1 Apr 90 to 31 Mar 91, indicates that he deployed in support of Operation DESERT STORM. He also received the Army Commendation Medal for service from 17 Jan 91 to 28 Feb 91 while assigned to an Army unit in direct support of Operation DESERT STORM. Though neither document provides exact locations, it is more than likely he was in the area of eligibility for the requested awards. In order for the applicant to be eligible for SWASM, w/3 BSSs, he would have needed to be serving in the area of eligibility on or after 12 Apr 91. Verification of an exact location or timeframe the applicant served in support of Operation DESERT STORM/SHIELD could not be attained, rendering him ineligible for the requested award. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 4 Aug 14 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice to warrant award of the SWASM, w/3 BSSs. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. 4. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant partial relief. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant’s records be amended to include the KLM-SA, KLM-K and the SWASM, w/2 BSSs. Accordingly, we recommend the applicant’s records be corrected to the extent indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that his DD Form 214, Certificate of Release or Discharge from Active Duty, issued in conjunction with his 20 August 1993, release from active duty, be amended to include the Kuwait Liberation Medal- Saudi Arabia, Kuwait Liberation Medal-Kuwait, and the Southwest Asia Service Medal with two (2) Bronze Service Stars.
