RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01198 COUNSEL: NONE HEARING DESIRED: NO ________________________________________________________________ APPLICANT REQUESTS THAT: She be awarded 33 non-paid retirement points for Retirement Year Ending (RYE) 11 Mar 14, to achieve a satisfactory year toward retirement. ________________________________________________________________ APPLICANT CONTENDS THAT: Due to her treatment and diagnosis of breast cancer, she was not allowed to participate and complete a satisfactory year for pay and points. The Air Force failed to notify her that a heart condition was documented in her medical record. If the medical personnel had made her aware of her tachycardia condition she could have informed her cancer treatment team. This would have resulted in her doctors implementing a difference course of treatment that would not have exacerbated the tachycardia condition. She has consistently completed all of her reserve requirements and currently has 14 years of satisfactory service. She needs 33 points to complete her Fiscal Year 2013 requirements. AFRC/SG denied her participation waiver. Therefore she was unable to complete her reserve requirement and attain another good year of service. Attaining 15 satisfactory years of service would give her the eligibility to be considered for an early reserve retirement. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ STATEMENT OF FACTS: On 12 Mar 99, the applicant enlisted in the Air Force Reserve (AFR) and is currently serving in the grade of Master Sergeant (MSgt, E-7). ________________________________________________________________ AIR FORCE EVALUATION: ARPC/DPTS recommends approval indicating the applicant’s medical circumstances and unit’s decision to discontinue the applicant’s participation prevented her from earning sufficient participation points to complete a qualifying year of service for RYE 11 Mar 14. The applicant has undergone treatment for cancer since 2011, followed by a diagnosed heart condition. In Sep 13, her unit requested that she complete her annual tour but she was unable to request her orders, due to the government shutdown. Once she was able to submit her request for the annual tour, it was denied until a medical review was accomplished by the Air Force Reserve Command (AFRC). On 4 Nov 13, she was subsequently denied continued participation. Until the contested year, the applicant had a spotless participation history, achieving 14 satisfactory service years through RYE 11 Mar 13. The complete DPTS evaluation, with attachment, is at Exhibit C. ________________________________________________________________ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 May 14 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). ________________________________________________________________ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant’s record be corrected as indicated below. ________________________________________________________________ THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that for Retention/Retirement Year 12 Mar 13 through 11 Mar 14, she was credited with an additional thirty-three (33) non-paid Inactive Duty Training (IDT) and fifteen (15) membership points resulting in 50 total points; and, this period was a year of satisfactory Federal service. ________________________________________________________________ The following members of the Board considered AFBCMR Docket Number BC-2014-01198 in Executive Session on 11 Feb 15, under the provisions of AFI 36-2603: , Panel Chair , Member , Member The following documentary evidence was considered: Exhibit A.
