RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01263 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect that he was promoted to the grade of major (O-4), effective 27 Feb 13, instead of 9 Oct 13, with a date of rank (DOR) of 5 May 13 (sic), instead of 30 Oct 13. APPLICANT CONTENDS THAT: Human error occurred between his state and National Guard Bureau (NGB) headquarters during the processing of his promotion eligibility. The error was discovered several months later and a subsequent investigation was conducted to find the missing promotion package. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant currently serves in the Air National Guard (ANG) in the grade of major (O-4), effective 9 Oct 13, and with a date of rank of 13 Oct 13. On 4 May 13, according to information provided by the applicant, he met the Federal Recognition Board and was selected for promotion to the grade of major (O-4). On 25 Jun 13, according to information provided by the applicant, the applicant’s name appears on Special Order A-29, as being promoted to the grade of major (O-4). On 30 Oct 13, according to information provided by the applicant, the applicant met a second Federal Recognition Board and was selected for promotion to the grade of major (O-4). The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: NGB/A1PO recommends relief be granted, indicating there is evidence of an error or injustice. The applicant was boarded for promotion on 4 May 13, but his promotion package was not processed correctly due to an administrative error. He was re- boarded for promotion on 30 Oct 13 and was subsequently processed for promotion, effective 27 Feb 14, on the November 2013 ANG Position Vacancy list. If the applicant's promotion had been processed correctly, he would have been placed on the June 2013 ANG Position Vacancy list and promoted to the grade of major (O-4) with a DOR of 4 May 13 and a Promotion Effective Date of 9 Oct 13 (the date that the June 2013 ANG Position Vacancy list was approved). Therefore, his DOR should be changed from 30 Oct 13 to 4 May 13, and his Promotion Effective Date be changed from 27 Feb 14, to 9 Oct 13. A complete copy of the NGB/A1PO evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 May 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his effective date of promotion to the grade of Major (O-4) is 9 Oct 13, and his date of rank is 4 May 13.
