RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01266 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her Home of Record (HOR) be corrected to reflect Columbus Ohio. APPLICANT CONTENDS THAT: Her HOR at time of entry into the Air Force should reflect Columbus, Ohio. She enlisted into the Air Force on 1 May 73 at Fort Hayes Army Base, Columbus, Ohio. In support of her request, she submits a letter of selection for the United States Air Force, dated 27 Jun 72 and an AF Form 941, Statement of Understanding (Delayed Enlistment Program) signed 18 Sep 72; which identifies Columbus Ohio as the place of signature. The letter was addressed to the applicant at Ohio 43219. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Air Force Reserve on 21 Sep 72. Block 41 of her DD Form 4/1, Enlistment Contract – Armed Forces of the United States, lists “Columbus, Ohio” as her HOR. The applicant initially entered the Regular Air Force on 5 Jan 73. Block 41 of her DD Form 4/1, Enlistment Contract – Armed Forces of the United States, lists “Columbus, Ohio” as her HOR. On 7 Oct 76, the applicant reenlisted for a period of four years. Block 5 of her DD Form 4/1, Enlistment/Reenlistment Document – Armed Forces of the United States, lists “Columbus, Ohio” as her HOR. On 7 Oct 80, the applicant reenlisted for a period of four years. Block 5 of her DD Form 4/1, Enlistment/Reenlistment Document – Armed Forces of the United States, lists “Columbus, Ohio” as her HOR. On 5 Oct 84, the applicant reenlisted for a period of four years. Block 5 of her DD Form 4/1, Enlistment/Reenlistment Document – Armed Forces of the United States, lists “Detroit, Michigan” as her HOR. On 3 Oct 88, the applicant reenlisted for a period of four years. Block 5 of her DD Form 4/1, Enlistment/Reenlistment Document – Armed Forces of the United States, list “Detroit, Michigan” as her HOR. On 31 Jan 93, the applicant retired with an Honorable discharge, and credited with 20 years and 26 days of active service. The remaining relevant facts pertaining to this application, extracted from the applicant’s military records, are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which are included at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSIPE recommends denial, indicating there is no evidence of an error or injustice. The HOR is the location identified by the individual upon entering the service, not a location where the individual is later assigned or a location selected for convenience; a correction must be fully justified. Domicile or legal residence may change, but the HOR will not. AFPC Enlisted Accessions Branch could not confirm that the applicant initialed her DD Form 4/1, as well as subsequent enlistments document listing Columbus, OH as her HOR. A complete copy of the AFPC/DPSIPE evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Sep 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant has provided sufficient evidence to raise doubt regarding the accuracy of her HOR. While we note AFPC/DPSIPE recommends denial, we believe the applicant’s initial enlistment contract to include eight subsequent years which reflect her HOR as Columbus OH is sufficient to prove by a preponderance of the evidence that her Home of Record was erroneously changed during her career. Therefore, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the applicant be corrected to show that “Columbus, Ohio” as her Home of Record.
