RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01409 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Report of Separation from Active Duty, be corrected to reflect the award of the following Air Force Medals and/or Ribbons: a. Air Force Overseas Ribbon – Short Tour (AFOR-S) b. Air Force Overseas Ribbon – Long Tour (AFOR-L) APPLICANT CONTENDS THAT: He served six months temporary duty and one year permanently stationed in Thailand which makes him eligible for both the AFOR-S and AFOR-L. In support of his request, the applicant submits a copy of his DD Form 214. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 23 Sep 71. On 22 Sep 75, the applicant was furnished an Honorable discharge, and was credited with 4 years of active service of which 1 year and 6 months were credited as Foreign Service. The applicant’s DD Form 214 reflects award of the following Air Force Medals and/or Ribbons: - National Defense Service Medal - Vietnam Service Medal - Republic of Vietnam Campaign Medal - Air Force Outstanding Unit Award - Small Arms Expert Marksmanship Ribbon - Air Force Longevity Service Award The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The AFOR was authorized by the Chief of Staff, United States Air Force, on 12 Oct 80. The ribbon was authorized to be awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Only individuals serving on active duty as of 6 Jan 86 are eligible to have the AFOR applied retroactively for completion of an overseas tour. After a thorough review of the applicant’s official military personnel record, they were unable to verify award of the AFOR-S or AFOR-L. The applicant’s dates of service are several years before the authorization date for the award of the AFOR, rendering the applicant ineligible for award of these ribbons. They were able to determine that the below Air Force Medal and/or Ribbon should have been awarded during the applicant’s service and are not reflected in his record: - Air Force Good Conduct Medal Upon final Board decision, administrative correction of the applicant’s official military personnel record will be completed by AFPC/DPSOR. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 1 Oct 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
