RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01415 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The Fitness Assessment (FA), dated 26 Sep 13 be declared void and removed from the Air Force Fitness Management System (AFFMS). APPLICANT CONTENDS THAT: The sit up component of the contested FA was unjustly administered by the Fitness Assessment Cell (FAC) representative. The FAC failed to inform him of incorrect sit-ups preformed in accordance with (IAW) AFI 36-2905, Fitness Program: If an incorrect sit-up is performed, assessor will repeat the number of the last correct sit-up and explain what is being done incorrectly. In this regard, the FAC representative failed to count the correct number of sit-ups, did not repeat the last number of the correct sit-up, and never told him what he was doing wrong. After the FA, he tried to approach the FAC representative to talk to him about the error before signing his final score sheet; however, at this point they did not allow him the opportunity to contest his sit-ups. Instead they directed him to sign the score sheet, which resulted in the failed FA. In support of his appeal, the applicant submits a personal letter to the board and a memorandum from his commander requesting that the FAC invalidate his FA. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On the date of the contested FA the applicant was serving in the Regular Air Force in the grade of Airman First Class (E-3). On 26 Sep 13, the applicant participated in the contested FA, attaining an overall composite score of 78.70, which constituted an “unsatisfactory” assessment. Provided by the applicant, a commander invalidation memorandum, addressed to the FAC (not dated), requests that the FA be invalidated and a new FA be administered. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit B. AIR FORCE EVALUATION: AFPC/DPSIM recommends denial of the applicant’s request to change the contested FA in AFFMS due to lack of supporting evidence. DPSIM states, in accordance with AFI 36-2905 (AFGM6, 2 Aug 13) Paragraph 26. "If a military member believes the administration of his/her FA or his/her FA score was in error or unjust, he/she may submit an application for correction of military records to the AFBCMR IAW AFI 36-2603, Air Force Board for Correction of Military Records." After a thorough review of the documentation provided by the applicant, there is insufficient evidence to support the applicant's claim. Although the applicant submitted a commander's invalidation memorandum there is no evidence submitted by the applicant's FAC or witnesses present to support the applicant's statement. A complete copy of the AFPC/DPSIM evaluation is at Exhibit B. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 01 Aug 14 for review and comment within 30 days (Exhibit C). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an injustice. After a thorough review of the evidence of record and the applicant’s complete submission, we believe the applicant is the victim of an error or injustice. While we note the comments of AFPC/DPSIM indicating that relief should be denied due to a lack of supporting evidence, we disagree. Although the applicant has not provided an official statement from the FAC stating there was an error in the administering of the FA, he has provided a personal statement and a memorandum addressed to the FAC from his commander, requesting that the FA be removed. Due to the subjective nature of the case we find the support from his commander as sufficient evidence to warrant removal. Therefore, we recommend the applicant’s records be corrected as set-forth below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that the Fitness Assessment, dated 26 September 2013, be declared void and removed from the Air Force Fitness Management System (AFFMS).
