RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-02588 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her records be corrected to reflect award of the Additional Special Pay (ASP) Medical Corps (MC) Contract for Fiscal Year 2013 (FY 13). APPLICANT CONTENDS THAT: On 6 May 13, she submitted her FY 13 ASP contract to her program coordinator. After obtaining all required signatures, the contract was forwarded to Air Force Personnel Center (AFPC) for processing; however, AFPC has indicated they never received the contract. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving on active duty in the grade of lieutenant colonel (O-5). The remaining relevant facts pertaining to this application are described in the memoranda prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: AFPC/DPANF recommends granting the requested relief. Title 37, United States Code, Chapter 5, Subchapter 302 (10 USC 302) authorizes several types of special pay, to include ASP, for medical officers in the Armed Forces. An ASP contract must be completed and submitted AFPC/DPANF with two months of the officer’s signature. The medical officer is required to agree in writing to remain on active duty for a least one year following the acceptance of the ASP. The criteria for incentive pay under the FY 13 Medical Officer Special Pay Plan in part are: the individual must be a medical officer in the Air Force, meet retainability requirements to complete an active duty service commitments (ADSC), a board certified physician, on active duty, and a current valid, unrestricted license. While the applicant met the eligibility criteria for the FY 13 ASP, a timely, completed contract was not received for payment. It was confirmed the ASP contract receipt notifications were sent to the applicant in 2012 and 2014; however, DPANF cannot confirm a 2013 ASP contract was received. A review of the applicant’s payment history revealed she has been receiving ASP since FY 10. She also has received ASP for FY 14. Therefore, since she has provided the ASP contract with original authorized endorsements with a fax cover sheet with the correct contact number for DPANF1; and the contract was completed two months prior to the effective date, DPANF recommends the approval for the FY 13 ASP. A complete copy of the AFPC/DPANF evaluation, with attachment, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 27 Jan 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that competent authority approved the applicant’s request for Additional Special Pay (ASP) for the period 1 July 2013 to 30 June 2014.
