RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-02596 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her deceased spouse’s DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to reflect the award of the following Air Force Medals and/or Ribbons: a. National Defense Service Medal (NDSM) b. Korean Defense Service Medal (KDSM) (ADMINSTRATIVELY CORRECTED) APPLICANT CONTENDS THAT: Her spouse was active duty during the Korean conflict and although deceased, his records should be corrected to reflect any and all Air Force Medals and/or Ribbons he is eligible for during his military service. In support of her request, the applicant provides copies of the service member’s DD Form 214 and death certificate. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The deceased service member initially entered the Regular Air Force on 30 Jul 54. Annotated on the service member’s AF Form 7, Airman Military Record, in Section 23, Awards, is the “National Def Sv Medal” with “No” listed under Issued or Presented. On 10 Dec 57, the service member was furnished an Honorable discharge, and was credited with 3 years, 4 months, and 11 days of active service. The service member’s DD Form 214, Block 26 – Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized, reflects “N/A”. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The NDSM is awarded for honorable active service as a member of the United States Armed Forces for any period between 27 Jun 50 and 27 Jul 54, between 1 Jan 61 and 14 Aug 74, between 2 Aug 90 and 30 Nov 95, and from 11 Sep 01 to a future date to be determined. A thorough review of the service member’s official military personnel record shows he was not serving on active duty during a conflict period in which the NDSM is authorized. However, they were able to determine that the below Air Force Medal and/or Ribbon should have been awarded: - Korean Defense Service Medal (KDSM) Upon final Board decision, administrative correction of the deceased service member’s official military personnel records will be completed by AFPC/DPSOR. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Nov 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion that relief beyond that already granted administratively is not warranted. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
