RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-02769 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be reimbursed $8,950.48 and credited with 17 service point for attending the Civil Engineering (CE) Basic Course during the period 27 Apr 14 through 13 May 14. APPLICANT CONTENDS THAT: He was unjustly denied the service credit and associated pay while in Temporary Duty Status (TDY) from 27 Apr 14 through 13 May 14 while attending the CE Basic Course. He submitted an accession package on 22 Apr 14 when transferring from the Air Force Reserve (AFRES) to the Ohio Air National Guard (OHANG) with the intent of completing the transfer before attending the CE Basic Course on 27 Apr 14. However, he was not gained to the OHANG until 14 May 14 due to delays. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant served as a rated officer in the AFRES in the grade lieutenant colonel (Lt Col) in Apr 14. On 11 Apr 14, the OHANG selected the applicant to serve as the OHANG Red Horse CE Squadron Commander. On 27 Apr 14, the applicant proceeded to Wright-Patterson AFB, OH to attend the CE Basic Course. On 14 May 14, the applicant was officially transferred to the OHANG. The remaining relevant facts pertaining to this application are contained in the memoranda prepared by the Air Force offices of primary responsibility (OPRs), which are attached at Exhibits C, D, and E. AIR FORCE EVALUATIONS: NGB/A1PP recommends denial indicating there is no evidence of an error or an injustice. The applicant is a rated officer who elected to transfer from the AFRES to a non-rated position with the OHANG. His desired transfer required the State of Ohio to submit a waiver to the National Guard Bureau Functional Manager to approve his being assigned to the position he sought. Because he did not have a background in the CE career field, the transfer required additional steps and the processing time was lengthy. The applicant was selected for a command position in CE with the OHANG. The applicant attended the in-residence CE Basic Course before the transfer was accomplished, with the approval of the AFRES, and expected the OHANG to pay for the course even though he was not yet assigned. There is no standard time to complete the accessions process, so the applicant’s argument that the process took too long is invalid. The applicant was not an OHANG asset when he reported to the CE Basic Course and cannot be accredited for pay and points from the ANG for the period of time which he was not a Guardsman. A complete copy of the NGB/A1PP evaluation is at Exhibit C. AFRC/A1K recommends partial approval indicating there is evidence of an error or an injustice. The applicant applied for a command CE position with the OHANG about 1 Mar 14, and was selected for the position on 11 Apr 14. While waiting for notification of his selection/non-selection, the applicant enrolled in the Distance Learning portion of the CE Basic Course in order to prepare for the in-residence portion if he was selected for the position. Upon notification of his selection, either the OHANG or the applicant (it is unclear) contacted AFIT to inquire about attending the in-residence CE Basic Course with the understanding that the applicant would be gained to the OHANG prior to the 28 Apr 14 class start date. On 16 Apr 14, the OHANG approved the assignment paperwork, and the applicant was notified the NGB would try to process his assignment by 25 Apr 14, prior to the class start date. However, the applicant was not officially transferred to the ANG until 14 May 14. Based upon the recommendation of AFRC/A1KE (Education and Training), A1KK recommends the applicant’s assignment effective date transferring him to the OHANG should be changed to 25 Apr 14. A complete copy of the AFRC/A1K evaluation is at Exhibit D. NGB/A7 does not make a recommendation, but provides an extensive chronology of NGB/A7’s thoughts and actions during the period of time in question, including that on 14 May 14 the NGB/A7 understood the OHANG would cut orders so the applicant could complete the CE Basic Course at AFIT in its entirety to include the portion at Tyndall AFB, FL. A complete copy of the NGB/A7 evaluation is at Exhibit E. APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS: Copies of the Air Force evaluations were forwarded to the applicant on 12 Aug 12, for review and comment within 30 days (Exhibit F). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of AFRC/A1K and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. In this respect, it appears the applicant is being held accountable for processing actions beyond his control. We note NGB/A1PP indicates the applicant’s Reserve unit erroneously prepared orders for Civil Engineer (CE) Basic Course before obtaining the required waiver, however, we note the chronology of events indicates on 23 Apr 14, the Ohio Air National Guard (OHANG) notified the applicant his employment package had been submitted to the National Guard Bureau (NGB) and the NGB would try to process it by 25 Apr 2014, prior to the start date of the CE Basic Course. As such, we are persuaded no complicity on the part of the applicant to erroneously attend the CE Basic Course has been established. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show on 25 April 2014, he transferred to the Ohio Air National Guard (OHANG), and competent authority approved his official travel and attendance in residence at the Civil Engineering Basic Course.
