RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03092 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect his Date of Rank (DOR) to the grade of Major (Maj, O-4) as 4 Aug 13, instead of 3 Jan 14, effective 27 Feb 14. APPLICANT CONTENDS THAT: Due to an administrator error, his position vacancy promotion request was omitted from the Oct 13 Position Vacancy List to the grade of Maj. If it was submitted in a timely manner, it would have been approved by the Secretary of Defense on 27 Feb 14. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: According to the applicant’s Air National Guard Service Agreement, on 27 Apr 12, he was appointed as an officer in the Air National Guard (ANG) and is currently serving in the grade of Maj. According to documentation provided by the applicant, on 29 Jul 13, his commander recommended he be promoted to the grade of Maj in promotion cycle 13B3C. According to Special Order (SO) AB-220, on 4 Aug 13, the applicant was promoted to the grade of Maj, effective 4 Aug 13 or upon approval of Federal Recognition. On 6 Aug 13, the promotion request was forwarded to the National Guard Bureau (NGB) for review and approval. According to SE AB-107, dated 3 Jan 14, the applicant’s promotion to the grade of Maj was revoked. On 3 Jan 14, the applicant’s commander forwarded a subsequent promotion recommendation to the grade of Maj for promotion cycle 13B3C. On 3 Jan 14, the applicant’s subsequent promotion request was forwarded to the National Guard Bureau (NGB) for review and approval. According to SO AB-106 dated 3 Jan 14, the applicant was promoted to the grade of Maj in the Mississippi ANG, effective 3 Jan 14 or upon approval of Federal Recognition. AIR FORCE EVALUATION: NGB/A1PO recommends approval indicating the applicant’s promotion package was not processed correctly due to an administrative error. The applicant was re-boarded for promotion on 3 Jan 14 and was subsequently promoted on a later list, effective 14 Jul 14. If the applicant’s promotion had been processed correctly, he would have been placed on the Sep 13 ANG Position Vacancy List (PVL) and promoted with a DOR of 4 Aug 13, effective 31 Jan 14 (the date the Feb 14 ANG PVL was approved). The complete A1PO evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 2 Feb 15 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT, be corrected to show that he was promoted to the grade of Major (O-4), with a date of rank of 4 Aug 13, effective 31 Jan 14.
