RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03141 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, Item 17c, Date of Entry, be corrected to reflect 29 Jun 72. APPLICANT CONTENDS THAT: He joined the Air Force on 29 Jun 72 and his DD Form 214 does not reflect his actual enlistment date. He is attempting to buy back his military service towards retirement with the United States Department of Justice. The service dates listed on his DD Form 214 must match the dates utilized by Defense Finance and Accounting Service (DFAS). The error on his DD Form 214 is preventing his Agency from processing his request. In support of his request, the applicant provides copies of his DD Form 214, a copy of his DFAS Statement of Earning, a copy of AFRES Form 116, Request and Authorization for Discharge and Enlistment/Reenlistment of Air Force Reserve Airman, and a copy of his AF Form 7, Airman Military Record. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Air Force Reserves on 30 Jun 72. On 26 Aug 72, the applicant entered the Regular Air Force and attended basic training. On 11 Feb 73, the applicant was furnished an Honorable discharge, and transferred to the Air Force Reserves based on the completion of Active Duty Training. He was credited with 5 months and 16 days of active service. The applicant’s DD Form 214 reflects 26 Aug 72 as the date of entry on active duty. On 29 Jun 78, the applicant was Honorably discharged from the Air Force Reserves and furnished with an AF Form 256AF, Honorable Discharge Certificate. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTS recommends denial indicating there is no evidence of an error or an injustice. They completed a review of the applicant’s personnel records and do not support changing his DD Form 214 to indicate a date of entry of 30 Jun 72. In accordance with AFI 36-3202, Separation Documents, Chapter 2, paragraph 2.2.3., the DD Form 214 provides separating members with brief, clear record of their active military service at the time they are transferred, released, discharged or retired. Although the member did enlist on 30 Jun 72, his active duty service did not start until 26 Aug 72 when he attended basic training. A complete copy of the ARPC/DPTS evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 20 Mar 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
