RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03242 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Report of Separation from Active Duty, be corrected to reflect his temporary duty (TDY) in Vietnam. APPLICANT CONTENDS THAT: It is in the interests of justice his record needs to be corrected based on his honorable service which has resulted in his ischemic heart disease and cancer. In 1971, he went to Westover Air Force Base, Chickpea, Massachusetts as part of the XX Transportation Squadron. He serviced C-123s which were used to spray Agent Orange in Vietnam. He then went TDY between 1972 and 1973 as part of the XX Transportation Squadron in support of mission BULLETSHOT. While there he drove a cargo truck and on at least five separate occasions, he and other service members loaded barrels onto the back of trucks to take to the Navy yard on the other side of the island only later discovering that the barrels in question were filled with Agent Orange. In approximately February 1972, while he was TDY to Guam, he volunteered for an assignment to Tan Son Nhut, Vietnam. While there, he again serviced C-123s and helicopters all of which were used to spray Agent Orange. While in Vietnam, he was knocked unconscious and received a head injury. He was carried by fellow service members to the make- shift hospital and received ten to fifteen stiches. He was told he had a concussion. In support of his request, the applicant provided a personal letter, a copy of his DD Form 214, and copies of his medical records. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 24 Jun 71. AF Form 909, Airman Performance Report, from 2 Feb 72 through 28 Dec 72 reflects the applicant’s Organization, Location and Command as XX Transportation Squadron, Westover AFB, MA w/ TDY XX Transportation Squadron, Andersen AFB, Guam (SAC). There was no back to this document within the applicant’s Master Personnel Record. On 20 Apr 75, the applicant was furnished an Honorable discharge, and was credited with 3 years, 9 months, and 27 days of active service. The applicant’s DD Form 214 reflects Foreign Service of 2 years, 9 months and 6 days. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPAPP recommends denial indicating there is no evidence of an error or an injustice. After a thorough review of the applicant’s official master personnel record they were able to verify and confirm Foreign Service at Andersen Air Force Base, Guam; but unable to verify any service in Vietnam. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Feb 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
