RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03445 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The following changes be made to his DD Form 214, Certificate of Release or Discharge from Active Duty: 1.  His Place of Entry (POE) onto Active Duty reflected in Block 7A be changed to Laughlin AFB, TX. 2.  His Home of Record (HOR) reflected in Block 7b be changed to Crystal Lake, IL. 3.  The Station Where Separated reflected in Block 8 be changed to Andrews AFB, MD. APPLICANT CONTENDS THAT: Two Special Orders (SO), SO AGA-281 and SO AC-017494 show different information than is reflected on his DD Form 214. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Air Force Reserve on 7 Feb 86. On 7 Feb 86, the applicant signed the AF Form 4, Enlistment/Reenlistment Document Armed Force of the United States, verifying his HOR was Maplewood, MN, and his POE was Minneapolis, MN. According to the documentation submitted by the applicant: 1.  SO AGA-281, dated 1 Mar 02, ordering him to Extended Active duty, identified his HOR address as Crystal Lake, IL, and the place he was to report for in-processing as Laughlin AFB, TX. 2.  SO AC-017494, dated 3 May 07, reflected his final base of assignment as Andrews AFB, MD. On 1 Jan 08, the applicant voluntarily retired, and was credited with 20 years and 16 days of active service. His DD Form 214 reflected Minneapolis, MN in Block 7a, Place of Entry into Active Duty; Maplewood, MN in Block 7b, Home of Record at Time of Entry; and, Randolph AFB, TX in Block 8, Station Where Separated. The remaining relevant facts pertaining to this application are contained in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are attached at Exhibits C and D. AIR FORCE EVALUATIONS: AFPC/DPSOR recommends denial indicating there is no evidence of an error or an injustice concerning the applicant’s request to change his “Station Where Separated” on his DD Form 214. The DD Form 214 is designed by the Department of Defense for consistent application of use between respective military branches of the service. AFI 36-3202 directs that the “Station Where Separated” reflect the “location of facility where separation documents are prepared.” The applicant’s separation documents were prepared at Randolph AFB, TX. The data on his DD Form 214 is accurately reflected in accordance with the governing directives. A complete copy of the AFPC/DPSOR evaluation is at Exhibit C. AFPC/DPSIPR recommends partially granting the applicant’s request. DPSIPR recommends denial indicating there is no evidence of an error or an injustice concerning his HOR on his DD Form 214. HOR is used to determine a service member’s home at the time of initial entry into the service and is defined as the place recorded as the home of the service member when commissioned, appointed, enlisted, inducted, or ordered into the tour of active duty. In accordance with the Joint Federal Travel Regulation (JFTR), a new HOR can only be established where there is a complete break in service to civilian status. A new tour of active duty service, even if it follows a break of more than one day, will not qualify without complete severance from service. The applicant listed Maplewood, MN as his HOR on both his AF Form 56, Application for Training Leading to a Commission in the United States Air Force, and his DD Form 4/1, Enlistment/Reenlistment Document. He then served continuously from the date of initial entry to active duty until his retirement. His EAD orders (Special Order-281) incorrectly reflected Crystal Lake, IL as this HOR. The applicant’s HOR is correct on his DD Form 214. However, the applicant has submitted sufficient justification to warrant a change to his POE on his DD Form 214. On 15 Mar 02, the applicant was ordered to EAD from the Reserve after a break in active service. His EAD orders (Special Order-281) reflect he was ordered from Reserve status to active duty from Crystal Lake, IL. Accordingly, Block 7a, Place of Entry into Active Duty, on his DD Form 214 should be corrected to reflect Crystal Lake, OK. A complete copy of the AFPC/DPSIPR evaluation, with attachments, is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATIONS: Copies of the Air Force evaluations were forwarded to the applicant on 15 Apr 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice concerning the applicant’s request to change his Home of Record or the Station Where Separated on his DD Form 214. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility (OPR) and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting said relief. 4.  Notwithstanding our determination above, sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice concerning the applicant’s request to change his Place of Entry into Active Duty on his DD Form 214. Concerning this issue, we agree with the opinion and recommendation of AFPC/DPSIPR and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his Place of Entry into Active Duty in Block 7a of his DD Form 214, Certificate of Release or Discharge from Active Duty, be changed to reflect Crystal Lake, IL.
