RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03473 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The following Decoration and Badge be added to his official military records: Bronze Service Star (BSS) to National Defense Service Medal (NDSM); (Administratively corrected) Headquarters Air Force (HAF) Badge. APPLICANT CONTENDS THAT: His DD Form 214 shows he received the NDSM, so he should receive the BSS for having served in DESERT SHIELD. The HAF Badge was activated after his retirement but can be given to anyone serving one year at the Pentagon. He served from Jul 74 through Aug 75 at the Pentagon. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 15 Jun 68, the applicant entered the Regular Air Force. According to the AF Form 77, Company Grade Officer Effectiveness Report, for the period 12 Apr 74 through 31 Mar 75, his duty was “HAF, Supply Operations Officer.” According to the AF Form 475, Education and Training Report, dated 5 Nov 75, for the period 1 Apr 75 through 7 Jul 75, he was assigned to the HQ USAF, Directorate of Maintenance, Engineering and Supply, Washington, D.C. in the Air Staff Training Program (ASTRA). According to the applicant’s Duty/Performance History, dated 15 Jun 89, his duty effective date as a supply operations officer at HAF was 23 Jul 74 and as a supply staff officer at HAF was 1 Apr 75. As an item accounting officer in base supply, his follow-on assignment duty effective date was 22 Sep 75. On 31 Mar 91, the applicant was relieved from active duty and retired, effective 1 Apr 91. He was credited with 22 years, 9 months and 16 days of active service. AIR FORCE EVALUATION: AFPC/DPSID recommends there is no action required as the National Defense Service Medal with one Bronze Service Star Medal was verified. After a thorough review of the applicant’s official military personnel record, DPSID was able to determine that the below Air Force Medal and/or Ribbon should have been awarded during his service from 15 Jun to 31 Mar 91 and was not reflected in his records. Administrative correction of the applicant’s official military personnel record will be completed by AFPC/DPSOR: * National Defense Service Medal with one Bronze Service Star (NDSM w/1BSS). The complete DPSID evaluation is at Exhibit C. AFPC/DPSIM recommends disapproval of the applicant’s request to have the HAF badge added to his DD Form 214, indicating the applicant has not exhausted all available avenues of administrative relief prior to seeking correction of his military records. The applicant did not provide any documentation to support serving in the Air Force District of Washington (AFDW). Per Air Staff, “Policy allows those previously assigned to HAF to wear the badge if they completed the required 365 days…this individual did not; however, he came very close. The applicant can request a waiver of the 365 days with an explanation of why his tour ended on 31 Mar of 75, therefore not allowing him to complete the 365 days.” The complete DPSIM evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant refutes the validity of the conclusions of the DPSIM advisory opinion and argues that the training report covering 1 Apr 75 through 7 Jul 75 and the Officer Effectiveness Report (OER) covering 12 Apr 74 through 31 Mar 75 he provides with his response clearly show he was at Headquarters Air Force for more than 365 days. The short period being an ASTRA officer only allowed a training report while his assignment in the Supply Directorate allowed for an actual OER. He served about 16 months at the Pentagon before going on a remote tour to Korea. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice with respect to the applicant’s request for award of the HAF badge. We took notice of the applicant’s complete submission, including attachments and rebuttal, in judging the merits of the case; however, we find no evidence of an error or injustice. We note that AFPC/DPSIM asserts that the applicant did not complete 365 days at the HAF, however, evidence from the applicant’s record proved the applicant did complete the necessary days for wear of the HAF badge. Despite this fact, we believe a records correction is not warranted due to the fact that the applicant’s duty history appropriately documents and serves as the evidence for award and wear of the HAF badge, thereby negating the need for an additional award document. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
