RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03487 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: She be credited with a satisfactory year of Reserve service for the retention/retirement (R/R) year 17 Jan 11 to 16 Jan 12. APPLICANT CONTENDS THAT: She received inaccurate service date information from unit leadership that resulted in her having unsatisfactory service for R/R year ending 16 Jan 12. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Air Force Reserve on 17 Jan 04. According to the applicant’s point credit accounting report summary (PCARS), for the R/R year 17 Jan 11 to 16 Jan 12 she earned 43 points, which does not constitute a satisfactory year of reserve service. A satisfactory year counting towards retirement requires that a minimum of 50 points be earned. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTS recommends granting relief, indicating sufficient evidence has been presented to demonstrate the existence of error or injustice. A review of the applicant’s records revealed she had a solid participation record with nine satisfactory service years until RYE 16 Jan 12. According to the applicant, her leadership’s inaccurate information led to the timing of her participation and failure to achieve a year of satisfactory service for RYE 16 Jan 12. Due to her leadership’s inaccurate account of her participation preventing her from earning sufficient participation points to complete a qualifying year of service for RYE 16 Jan 12 (no fault of the applicant), they recommend her record be corrected to show she was awarded 7 additional non-paid inactive duty training (IDT) points for RYE 16 Jan 12, giving the applicant a total of 50 retirement points and a year of satisfactory service. A complete copy of the ARPC/DPTS evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Nov 14 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an injustice. We took notice of the applicant’s complete submission in judging the merits of the case, and while we note the opinion and recommendation of ARPC/DPTS, we believe that there is an absence of relevant evidence substantiating the applicant’s contention that she received inaccurate service date information from unit leadership that resulted in her having unsatisfactory service for RYE 16 Jan 12. While the applicant argues that erroneous information from her leadership caused her to not earn the requisite 50 points required for a satisfactory year of service, other than her own uncorroborated assertions, she has provided no evidence whatsoever that she was somehow miscounseled. Should the applicant provide evidence supporting this argument, such as supporting statements from members of her command attesting to the fact that her predicament was the result of miscounseling, we would be willing to reconsider the matter based on new evidence. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
