RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03651 XXXXXXXXXX COUNSEL: NONE HEARING DESIRED: YES APPLICANT REQUESTS THAT: She be considered for a Special Selection Board (SSB) in lieu of the Calendar Year 2014 United States Air Force Reserve Lieutenant Colonel Position Vacancy (PV) Promotion Selection board. APPLICANT CONTENDS THAT: Due to an administrative error outside of her control, her AF Form 709, Promotion Recommendation, was not received by ARPC within the established time. In support of her request the applicant provides copies of a memorandum from her unit attesting to the administrative error and AF Form 709. The applicant's complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently servicing in the Air Force Reserve in the grade of major (O-4). AIR FORCE EVALUATION: ARPC/PB recommends approval. Per SAF/GCI guidance, the convening notice is a Secretarial act in support of the Secretarial process and there is no additional waiver authority in AFI 36-2504, Promotion, Continuation and Selective Early Removal in the Reserve of the Air Force, for PV Promotion Recommendation Forms (PRFs). Any PRF accepted past the established suspense date is not consistent with Secretarial direction. Only the Secretary of the Air Force can give authority to deviate from the suspense. The 811th FSS/AAH letter, contained in the applicant's request, states the PRF was not submitted properly by HAF/ESP. The letter also states the error was not identified until after the board had adjourned. Though the PRF was not received by ARPC/PB before the established suspense date mandated in the published convening notice, the error was not caused by the senior rater or applicant. APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: On 28 November 2014, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit C). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting relief. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant's records be corrected as set forth below. 4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issue(s) involved. Therefore, the request for a hearing is not favorably considered. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that her record be considered for promotion to the grade of lieutenant colonel by a Special Selection Board for the Calendar Year 2014 United States Air Force Reserve Lieutenant Colonel Position Vacancy Promotion Board.
