Air Force Outstanding Unit Award with two Bronze Oak Leaf Clusters (AFOUA w/2BOLC) (Administratively resolved). 2. Air Force Good Conduct Medal with three Bronze Oak Leaf Clusters (AFGCM w/3BOLC). 3. Air Force Longevity Service Award with two Bronze Oak Leaf Clusters (AFLSA w/2BOLC). Additionally, his DD Form 214 Certificate of Release or Discharge from Active Duty, for the period of service 23 Aug 76 to 22 May 81, be corrected to add the following badge: 4. Security Forces Badge (Administratively resolved). APPLICANT CONTENDS THAT: His service with the 96th Security Police Squadron and the 8th Security Police Squadron make him eligible for award of the AFOUA w/2BOLC. In addition, for each year of service in Vietnam and each subsequent three year period of service he should be awarded the AFGCM w/3BOLC. He should also be awarded the Air Force Longevity Service Ribbon with one Bronze Oak Leaf Cluster for his active duty service or the Air Force Longevity Service Ribbon with two Bronze Oak Leaf Clusters if his reserve/guard justifies an additional award. He should be awarded the Security Forces Badge since he held the Security Forces Air Force Specialty Code (AFSC). The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 5 Sep 72. On 22 May 81, the applicant was discharged with an honorable characterization of service and was credited with 9 years and 18 days of active service. The Air Force Good Conduct Medal was authorized by the Secretary of the Air Force on 1 Jun 63. The medal is awarded to enlisted personnel during a three-year period of active military service or for a one-year period of service during a time of war. Airmen awarded this medal must have had character and efficiency ratings of excellent or higher throughout the qualifying period. In accordance with Executive Order 8809, amended by Executive Order 9323 the Air Force Good Conduct Medal may also be awarded to service members who complete more than one year but less than three years if the Air Force Good Conduct Medal has not been previously awarded. Qualifying periods of service: each three years completed on or after 1 Jun 63; for first award only, upon termination of service on or after 1 Jun 63, or less than three years but more than one year; for first award only, upon termination of service, on or after 1 Jun 63, or less than one year when final separation was by reason of physical disability incurred in line of duty; for first award only, for those members who died before completing one year of active Federal military service if the death occurred in the line of duty. The above timeframes are decreased to one year any time that the United States is at war, as declared by the United States Congress. The entire year must have been served in the area of eligibility during the period indicated. The Air Force Longevity Service Award is awarded to active duty personnel based on an aggregate of four years of honorable active federal military service with any branch of the Armed Forces of the United States or Reserve components. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice with respect to the applicant’s requests for the AFGCM and AFLSA. As for the applicant’s request for award of the Air Force Outstanding Unit Award with two Bronze Oak Leaf Clusters, they were able to verify that the applicant was assigned to the 96th Security Police Squadron, Dyess Air Force Base, Texas, between 2 Sep 72 and 30 Apr 75 and again between 22 Jul 78 and 22 May 81. The 96th Security Police Squadron received award of the Air Force Outstanding Unit Award for award period from 1 Jul 74 to 30 Jun 75 and 1 Jul 78 to 30 Jun 80. The applicant was assigned to the 8th Security Police Squadron, Kunsan Air Base, Korea, from 8 Aug 77 to 4 Aug 78. The 8th Security Police Squadron received award of the Air Force Outstanding Unit Award for award period from 1 Apr 77 to 31 Mar 78. Upon final board decision, the applicant’s DD Form 214 will be amended. The applicant requests award of the Air Force Good Conduct Medal for each year he served during the Vietnam Conflict, from 5 Sep 72 to 4 Sep 74. When the United States is considered to be at war, the timeframes for award of the Air Force Good Conduct Medal is decreased to one year. However, during the Vietnam Conflict, there was no formal declaration of war made by the United States Congress; therefore, the applicant is not eligible to receive award of the Air Force Good Conduct Medal for every year of his service during the Vietnam Conflict. The applicant is considered for award of the Air Force Good Conduct Medal based on each three years of qualifying service; the applicant is eligible for award of the Air Force Good Conduct Medal with two Bronze Oak Leaf Clusters (AFGCM w/2BOLC) for his 9 years and 18 days of active duty service. The applicant requests award of the Air Force Longevity Service Award with two Bronze Oak Leaf Clusters for his Reserve/Air National Guard service; however, they were unable to verify the applicant was credited with an aggregate of four years of active duty Reserve or Air National Guard service. However, they were able to verify award of the Air Force Longevity Service Award with one Bronze Oak Leaf Cluster (AFLSA w/1BOLC) for the applicant’s active duty service from 5 Sep 72 to 22 May 81, for a total of 9 years and 18 days. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 26 May 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD DETERMINES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice with respect to his request for award of the Air Force Longevity Service Award and the Air Force Good Conduct Medal. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. We note the Air Force OPR has determined the applicant’s eligibility for the Air Force Outstanding Unit Award with two Bronze Oak Leaf Clusters (AFOUA w/2BOLC), Air Force Good Conduct Medal with two Bronze Oak Leaf Clusters (AFGCM w/2BOLC), the Air Force Longevity Service Award with one Bronze Oak Leaf Cluster (AFLSA w/1BOLC) and award of the Security Forces Badge and will correct his records administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
