RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03817 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. Her separation code of RBC, which denotes “Voluntary Retirement: Maximum Service or Time in Grade,” be changed to SCC which denotes “Mandatory Retirement: Reduction in Force.” 2. The $5,000 debt resulting from the incorrect separation code be invalidated. APPLICANT CONTENDS THAT: On 14 February 2014, she contacted the Air Force Personnel Center for guidance regarding her retirement and was told to log into the virtual Military Personnel Flight (vMPF) and select the retirement option. She was not informed this would forfeit her involuntary retirement status. She had no intention to retire voluntarily and discussed this fact many times with her commander. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 20 February 1989, the applicant entered the Regular Air Force. On 1 July 2014, the applicant retired and was credited with 25 years, 4 months, and 11 days of active service. Her separation code is RBC. According to DFAS-IN Form 0-641, Statement of Military Pay Account, dated 17 October 2014, the recoupment is required for the unearned portion of her medical/dental/nurse bonus based on her separation code of RBC. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force office of primary responsibility, which is included at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOR recommends approval. The applicant was considered and selected for early retirement by the Calendar Year (CY) 2013 Selective Early Retirement Board (SERB). Personnel Services Delivery Memorandum (PSDM) 14-05 was used to announce the notification process for senior raters to advise officers of their status following the CY 2013 SERB. The PSDM also provided impacted officers the option of being retired with the separation code SCC, which indicates mandatory retirement, or applying for a voluntary retirement on their mandatory retirement date with a separation code of RBC. The applicant was notified of the results on 21 January 2014. On 14 February 2014, she submitted a retirement eligibility request through the vMPF; however, she did not apply for retirement. Her retirement was inadvertently approved on 18 February 2014. The applicant's records indicate that she did not apply for retirement, yet it was automatically updated; therefore, her separation code should have reflected SCC, rather than RBC. A complete copy of the DPSOR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 6 May 2015, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. Having carefully reviewed this application, we agree with the recommendation of the Air Force office of primary responsibility and adopt the rationale expressed as the basis for our decision that the applicant has been the victim of either an error or an injustice. Therefore, we recommend the applicant's records be corrected as set forth below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that: On 30 June 2014, she was released from active duty with a separation code of SCC which denotes Mandatory Retirement: Reduction in Force. Her $5,000 Incentive Special Pay debt be invalidated, and the debt be removed from her pay account.
