RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03867 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Her records be corrected to reflect a promotion to the rank of Senior Airman (SrA) upon graduating Technical Training School and all pay and allowances be adjusted accordingly. APPLICANT CONTENDS THAT: Based on her 63 semester hours of college education she should have been promoted to the rank of SrA upon graduating Technical Training School. Her recruiter never informed her of this possibility even though she provided copies of her college transcripts prior to her enlistment. She also provided copies to the Reserve Liaison during basic military training (BMT). In support of her request, the applicant provided an “Unofficial” copy of her college transcripts from Park University. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the Air Force Reserve in the grade of Staff Sergeant. On 29 Apr 11, the applicant signed DD Form 4, Enlistment/Reenlistment Documents Armed Forces of the United States, in which she enlisted in the Air Force Reserve for 6 years in the pay grade of E-1(AB). On an unknown date, the DD Form 4 was corrected and the grade of E-1 was crossed out and E-3 (A1C) was handwritten in. On 31 May 11, the applicant’s DD Form 1966, Record of Military Processing - Armed Forces of the United States, Page 3, Section IV - Certification, Block 32a, Specific Option/Program Enlisted for, lists the following: “NPS Program -- AFSC: 3M051, Services -- Base: Luke AFB, AZ -- Unit: 944 FSS -- Grade E-1/AB -- No Bonus”. On an unknown date, the DD Form 1966, Page 3, Section IV, Block 32a was corrected and the grade of E-1 was crossed out and E-3 (A1C) was handwritten in. Listed on the Continuation of DD Form 1966, Section IV, Remarks, the applicant initialed the following statement: “NPS Without Proof of Education and Training” -- “I understand that if I present College Transcripts prior to my completion of Basic Military Training I may be eligible for enlistment in a higher grade. I elect to enlist in the grade of E-3 prior to the receipt of this document. I understand that I must present official documents to be awarded an increased grade after enlistment.” On 2 Jun 12, the applicant was promoted to the permanent grade of E-4 (SrA) with a date of rank of 22 May 12. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFRC/RSOO recommends denial indicating there is no evidence of an error or an injustice. There is no documentation to support the applicant request that she be promoted to SrA after graduating technical training school. In accordance with Air Force Reserve Recruiting Procedures within Air Force Reserve Command Instruction 36-2001, Recruiting Procedures for the Air Force, Table 5.1., Note 5: “Documents presented after enlistment may be used as a basis for changing the authorized enlistment grade up until BMT graduation. Recruiters will advise applicants to obtain documents before enlistment. However, this policy will allow an applicant who is in the process of completing additional college classes, etc. that will qualify them for a higher grade, to have the opportunity to have their records updated to reflect the higher grade.” The applicant must provide “Official” transcripts from an educational institution listed with the Accredited Institution of Postsecondary Education (AICE) published by the American Council on Education (ACE) reflecting certification during the last year the applicant attended. While the applicant states she provided transcripts to her recruiter and the BMT liaison, they could not substantiate her claims. They note that the transcripts provided in her application are stamped “Unofficial”. Official transcripts are required to be dated and presented prior to completing BMT. After a thorough review of the applicant’s record they could not substantiate her claim and have no record she provided the required transcripts in time for a grade adjustment. A complete copy of the AFRC/RSOO evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Feb 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
