RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03912 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: She be granted a Special Board in lieu of the Calendar Year 2014 Lieutenant Colonel Position Vacancy (CY14 Lt Col PV) Promotion Selection Board. APPLICANT CONTENDS THAT: Her Promotion Recommendation Form (PRF) for the CY14 Lt Col PV Promotion Selection Board was uploaded by her senior rater’s executive officer on 7 Apr 14, in ample time to meet the PRF suspense date for the board. However, due to an issue arising during the upload process, her PRF remained in the system in “case uploaded” status but never reached the Air Reserve Personnel Center and, as a result, she was not considered by the Board as her senior rater intended. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant served in the Air Force Reserve in the grade of major (0-4) during the period of time in question. The remaining relevant facts pertaining to this application are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is included at Exhibit C. AIR FORCE EVALUATION: ARPC/PB recommends granting the applicant’s request, indicating there is evidence of an error or injustice. Several months prior to convening a PV Board, ARPC/PB provides board convening notices containing the deadline for submission of PRFs. The convening notice is a Secretary of the Air Force (SecAF) act in support of a Secretarial process. Any PRF received past the established suspense date is not consistent with SecAF direction, and only the SecAF has the authority to deviate from the suspense date. The convening notice for the CY14 Lt Col PV Promotion Selection Board was released on 10 Jan 14, and the deadline for PRF submittal was 25 Apr 14. The applicant’s AF Form 709, Promotion Recommendation Form (PRF), was not received by the established suspense date. According to the OO-ALC/CCE letter submitted by the applicant, her PRF was not submitted properly by the executive officer, and the error was not identified until 21 Aug 14, well after the Board had adjourned. The error was not the fault of the applicant. A complete copy of the ARPC/PB evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 17 Nov 14 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of ARPC/PB and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. Therefore, we recommend the applicant's records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to ensure her records be considered for supplemental promotion to the grade of lieutenant colonel (O-5) for the Calendar Year 2014 Lieutenant Colonel Position Vacancy Promotion Selection Board.
