RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-03938 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. His records be corrected to reflect that he was awarded the Air Force Commendation Medal with second Oak Leaf Cluster (AFCM w/2OLC) (Administratively Corrected). 2. He be considered for supplemental promotion consideration to the grade of Technical Sergeant (TSgt) by the 14E6 promotion cycle, with the AFCM w/2OLC included in his record. APPLICANT CONTENDS THAT: The recommendation for award of the AFCM w/2OLC was lost and not resubmitted prior to his Permanent Change of Station (PCS) and as a result, he missed being promoted during cycle 14E6. In support of his requests, the applicant provides a letter dated 18 Jul 14, from his commander stating the applicant’s AFCM submission was not submitted in a timely manner due to a changeover in staff and computer and e-mail issues. He also provides a copy of the AFCM w/2OLC certificate for the period of 16 Jun 11 to 15 Nov 13, with a given under my hand date of 11 Jul 14 and the DECOR6 dated 11 July 14. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 14 Oct 03, the applicant entered the Regular Air Force and is currently serving on active duty in the grade of Staff Sergeant (SSgt, E-5). AIR FORCE EVALUATION: AFPC/DPSID states no action is required in regards to the applicant’s request for award of the AFCM w/2OLC. After a thorough review of the applicant’s official military record, they were able to verify the existence of an error as the AFCM w/2OLC was not reflected in the Automated Records Management System (ARMS) or in the Military Personnel Data System (MILPDS). Special Order G-0031 was forwarded to the ARMS to be updated and MILPDS has been updated to reflect the applicant having a total of three AFCMs. The complete DPSID evaluation is at Exhibit C. AFPC/DPSOE recommends denial of the applicant’s requests to include the AFCM in the promotion process for cycle 14E6 as the decoration was not submitted until after selections were made and announced for the promotion cycle. The applicant was considered and non-selected for promotion to the grade of TSgt for Cycle 14E6. The score required for selection in his Air Force Specialty Code (AFSC) was 333.50 and his total weighted promotion score was 333.04. If the AFCM, worth 3 points, was counted in his total score, he would become a selectee for promotion. Current Air Force promotion policy, AFI 36-2502, Airman Promotion Program, Table 2.2, Rule 5, Note 2, dictates that before a decoration is credited for a specific promotion cycle, the close out date of the decoration must be on or before the Promotion Eligibility Cutoff Date (PECD), and the date of the Decor 6 must be before the date of selections for the cycle. The PECD for Cycle 14E6 was 31 Dec 13. In addition, a decoration that a member claims was lost or downgraded must be fully documented and verified that it was placed into official channels prior to the selection date. Promotion selections for this cycle were made on 7 Jun 14 with a public release date of 26 Jun 14. The complete DPSOE evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 10 Feb 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We note that DPSOE recommends denial stating the decoration was not submitted until after selections were made and announced for the promotion cycle. However, we find the statement from his commander, a senior officer, stating the applicant’s AFCM submission was not submitted in a timely manner due to a changeover in staff and computer and e-mail issues sufficient to grant the requested relief. Additionally, we note that DPSID has verified the applicant is entitled to award of the AFCM w/2OLC and has corrected his records administratively. Therefore, we recommend the applicant’s records be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military record of the Department of the Air Force relating to APPLICANT, be corrected to show that: a. The Recommendation for Decoration Printout (RDP) for the award of the Air Force Commendation Medal (AFCM), Second Oak Leaf Cluster (2OLC), covering the period of 16 Jun 11 to 15 Nov 13 was signed by the commander on 1 Dec 13, rather than 1 Jul 14. b. It is further directed that he be provided supplemental consideration for promotion to the grade of technical sergeant for promotion cycle 14E6, with the AFCM w/2OLC included in his record.
