RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04223 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His date of commission be changed from 12 Apr 11 to 4 Apr 11. APPLICANT CONTENDS THAT: He was commissioned on 4 Apr 11, one day prior to his 35th birthday. By 4 Apr 11, he had completed all of the Officer Training School (OTS) requirements to graduate, and his OTS commander wanted him to be commissioned prior to his 35th birthday. His commander sent the incorrect form to AFPC in error, then provided him a copy of the correct form. This is important to his career, and effects his promotion date and seniority. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant entered active duty in the Air Force Reserve on 11 Jan 11 in order to attend the Officer Basic Military Training Pre-commissioning Course. According to the documentation submitted by the applicant, his commander signed his AF IMT 133, Oath of Office, on 4 Apr 11. On 11 Apr 11, the applicant was released from active duty after completing his required active duty training, and was credited with three months and one day of service this period. On 12 Apr 11, the applicant’s commander signed the AF IMT 133 which appears in his official military records. Under Reserve Order PA-00562, Appointment Order, dated 28 Apr 11, the applicant was appointed in the Reserve of the Air Force in the grade of second lieutenant on 12 Apr 11. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: Officer Training School Commandant (OTS/CC) recommends denial indicating there is no evidence of an error or an injustice. An age waiver is only required to enter OTS, and has no bearing on the remainder of a service member’s career. The applicant was commissioned on 12 Jul 11. OTS does not commission individual cadets earlier than their scheduled graduation/commissioning date in order to meet specific age requirements. A complete copy of the OTS evaluation, with attachments, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 24 Aug 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of OTS/CC and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
