RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04319 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: Award of the Civil Engineering (CE) Occupational Badge be added to his military record. APPLICANT CONTENDS THAT: He was awarded the CE Occupational Badge, but it is not documented in his military personnel records. Per AFI 36-2923, he was awarded the badge and it should be reflected in his records. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 16 Aug 89, the applicant entered the Regular Air Force. On 16 Aug 93, the applicant was released from active duty after expiration of his obligated term of service and transferred to the Air Force Reserves. He was credited with 4 years of active service. The applicant reenlisted into the Air Force Reserve on 5 Mar 94 and was discharged in 1998. The applicant served in the Air National guard from March 1998 until his discharge in March 2000. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFRC/A1K recommends disapproval indicating there is no evidence of an error or an injustice. The 914 CES/CC memorandum is the military source document due to the member not meeting the requirements of receiving a DD Form 214, Certificate of Release or Discharge from Active Duty, IAW AFI 36-3202 paragraph 4.5. The Air Force Reserve requirements in accordance with AFI 36- 3202, Separation Documents, issuing DD Forms 214 are for the following reasons: Personnel who complete 90 continuous days or more of active duty for training, full-time training or active duty for special work; Personnel who complete initial active duty training regardless of the number of days; Personnel who are ordered to active duty for a contingency operation regardless of the number of days served on active duty and Personnel who complete an Active Guard/Reserve (AGR) tour of 90 continuous days or more. After a careful review of the documentation provided by the applicant, the military personnel record source documents and Air Force Policy documents, it was discovered that a) the member did not serve on 90 continuous days or more for any of the reasons listed in the above paragraph while serving in the Air Force Reserve for the issuance of a DD Form 214 and b) the Basic Civil Engineering Occupational Badge is awarded after completing initial 3-level training. Though the member received a memorandum from the 914th Civil Engineer Squadron Commander authorizing him to wear the applicable occupational badge, the Military Personnel Data System does not have an updated application reflecting award of the Occupational Badge since the award and authorization is based on the completion of the required skill level training. To grant relief would be contrary to the criteria established in AFI 36-2903, Dress and Appearance of Air Force Personnel, Chapter 10, paragraph 10.4.3 and AFI 36-3202, Separation Documents, paragraph 4.5. The complete AFRC/A1K evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 30 Jun 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission, including attachments, in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. While we acknowledge the applicant’s request to have the Civil Engineering Occupational Badge documented in his military personnel record, the Board notes the applicant has not provided evidence that supports his application. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
