RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04400 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His retired grade of master sergeant (E-7) be upgraded to senior master sergeant (E-8) commensurate with the Air Force Specialty Code (AFSC) 3E290, Superintendent Pavements & Construction, he was serving in at the time of his permanent disability retirement. APPLICANT CONTENDS THAT: The duty position he held at the time of his disability retirement was Superintendent Pavements & Construction, AFSC 3E290 (commensurate with the grade senior master sergeant (E-8)). According to AFI 36-3212, Physical Evaluation for Retention, Retirement, and Separation, para 5.15, Grade on Retirement: Grade on Retirement, the grade in which the member is serving on the date placed on TDRL or on the date permanently retired for disability, para 5.16, Higher Grade Determined by SAF: A grade in which the member served satisfactorily on active duty, as determined by the SAF, pursuant to 10 U.S.C. 1212. The primary specialty section 11, of his DD Form 214, Certificate of Release or Discharge from Active Duty, shows 3E290, Superintendent Pavements & Construction for a period of 8 months. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 1 Nov 10, the applicant was assigned, in the grade of master sergeant (E-7), as Superintendent Pavements & Construction, Duty AFSC 3E290, with the California Air National Guard. On 29 Aug 14, under Special Orders ACD-02764, dated 16 Jul 14, the applicant was permanently retired for physical disability with a combined compensable disability rating of 30 percent. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPFD recommends denial indicating there is no evidence of an error or an injustice. A review of the documents in the Automated Records Management System (ARMS) and the applicant’s disability file revealed he was assigned to a position with a duty AFSC of 3E290, Superintendent Pavements & Construction for a short period of time but was not awarded the grade commensurate with that skill level. The files reviewed did not reveal any promotion documents or orders reflecting he was awarded a higher grade. IAW AFI 36-3212, if an enlisted person has served on active duty in a grade higher than current grade, he/she must forward a copy of a promotion order, a copy of the document authorizing demotion, and a copy of all performance evaluations rendered while serving in a grade higher than current grade. The applicant has failed to provide these documents. The preponderance of evidence reflects that no error or injustice occurred during the applicant’s disability process. A complete copy of the AFPC/DPFD evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 11 Feb 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
