RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04417 COUNSEL: NONE HEARING DESIRED: YES APPLICANT REQUESTS THAT: The effective date of his Additional Special Pay (ASP) Dental Corps Contract be changed to 27 Jun 14 rather than 1 Aug 14. APPLICANT CONTENDS THAT: The Yokota credentials manager sent out his ASP Contract in May l4. He has the signed/dated contract documents that he sent out in May; however, all of his emails were deleted during his change of assignment to Hickam in June l4. He was told to wait up to three months and be patient. In Aug 14, he emailed the credentials manager at Yokota, since he did not yet receive his $12,000.00 ASP pay. However, he was told that he should not re-send another copy because they do not want duplicates. He has queried the Air Force Personnel Center (AFPC); however, they have no records of his ASP 2014 contract. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: Based on the available records, on 9 May 14, the applicant signed an ASP contract, for a period of 1 year. On 14 May 14, the Yokota Credential Manager verified the contract. On 19 May 14, the commander approved the contract, with an effective date of 1 Jun 14. AIR FORCE EVALUATION: AFPC/DPAN recommends approval, indicating a completely signed contract was provided to DPANF1 in a less than timely manner due to possible process failures beyond the applicant’s control. DPANF agrees the contract effective date and active duty service commitment should be changed. However, the correct effective date should be 27 Jun 14 based on completion of the previous year’s contract commitment. Using an earlier effective date than 27 Jun 14 would result in an overlapping period from 1 Jun 14 to 26 Jun 14. The applicant must be notified that a 27 Jun 15 ASP contract must be submitted to avoid any future pay issues or commitment extensions. According to the Fiscal Year 2014 (FY14) Dental Officer Special Pay Plan, sections 1.3 and 5, the applicant met all requirements for ASP eligibility; however, a timely, completed contract was not received by AFPC/DPANF1 to process for payment. According to the email traffic included in the BCMR package, the first inquiry about the 1 Jun 14 ASP payment was in Oct 14. The applicant received ASP in 2013, effective from 27 Jun 13 – 26 Jun 14. The requested 1 Jun 14 effective date is incorrect. The applicant needs to complete his FY13 commitment before he can start his FY14 pay; therefore, the FY14 effective date cannot start before 27 Jun 14. The applicant did receive his 2014 ASP payment; however, the effective date was 1 Aug 14 – 31 Jul 15. The complete DPANF evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 26 May 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant's complete submission in judging the merits of the case and agree with the opinion and recommendation of AFPC/DPANF and adopt its rationale as the basis for our conclusion the applicant has been the victim of an error or injustice. The Board did note AFPC/DPANF’s reference to a DFAS recommendation, however, said recommendation was absent from the case file and not presented to the applicant. Additionally, in view of the fact the contract in question has expired, we believe it appropriate to correct the applicant’s record to show that his 2015 contract he signed on 22 Jun 15, be changed to reflect an effective date of 27 Jun 15 rather than 23 Jun 15. Therefore, we recommend the applicant's records be corrected as indicated below. 4. The applicant’s case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that: a. His Additional Special Pay (ASP) Dental Corps contract, signed on 9 May 2014, was effective 27 June 2014 rather than 1 August 2014, effective for the period 27 June 2014 through 26 June 2015. b. His ASP contract, signed on 22 June 2015, was effective 27 June 2015 rather than 23 June 2015, effective for the period 27 June 2015 through 26 June 2016.
