RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04451 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: He be awarded the Presidential Unit Citation (PUC). APPLICANT CONTENDS THAT: He served with the 27th Fighter Wing and the 522nd Fireball Squadron, which entitles him to the PUC. A fellow veteran pointed out to him that there unit was entitled to the PUC. The Board should find it in the interest of justice to consider his untimely application because he served during the Korean War and was sent to Japan and if his unit was awarded the PUC he would like to have it in his records as well. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 4 Oct 51, the applicant initially entered the Regular Air Force. On 3 Oct 55, the applicant was released from active duty and transferred to the Air Force Reserve. He was credited with four years of active service and 7 months and 23 days of foreign service. Upon final Board action, DPSOR will administratively correct the applicant’s record to reflect award of the Air Force Longevity Service Award (AFLSA). AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating while 522nd Fighter- Escort Squadron did receive award of the PUC as well as the Republic of Korea PUC; however, the applicant was not assigned to the unit during either award inclusive periods as he was not yet serving on active duty. Therefore, the applicant is ineligible for award of the PUC and the Republic of Korea PUC. To grant relief would be contrary to the criteria established by DoDM 1348.33, Secretary of the Air Force, Chief of Staff, and/or the War Department. After a thorough review of the applicant's official military personnel record, DPSID was unable to verify award of the PUC and the Republic of Korea PUC. The applicant entered active duty on 4 Oct 51 and was assigned to the 522nd Fighter-Escort Squadron (redesignated the 522nd Strategic Fighter Squadron) from 6 Oct 52 to 12 Feb 53. The 522nd Fighter-Escort Squadron received award of the PUC for award inclusive period from 26 Jan 51 to 21 Apr 51. The 522nd Fighter-Escort Squadron also received award of the Republic of Korea PUC for award inclusive period from 9 Nov 50 to 31 May 51; both award inclusive periods are prior to the applicant's active duty service; therefore, rendering him ineligible for either award. Based on our review of the applicant's official military personnel record, DPSID was able to determine that upon final board decision, administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR to award the applicant the Air Force Longevity Service Award (AFLSA). The complete DPSID evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 6 Mar 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, other than the aforementioned administrative relief, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
