RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04517 XXXXXXXXXX COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: The following medals be added to his DD Form 214, Certificate of Release or Discharge from Active Duty: a. Meritorious Service Medal with three Bronze Oak Leaf Clusters (MSM w/3BOLCs). (Will be administratively corrected.) b. Air Force Expeditionary Service Ribbon with Gold Border and one BOLC (AFESR w/GB and 1BOLC). (Will be administratively corrected.) c. Global War on Terrorism Expeditionary Medal (GWOT-E w/1BOLC). APPLICANT CONTENDS THAT: He was deployed in 2007 and 2010 and was awarded the GWOT-E medal and the AFESR w/GB. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 10 August 1992, the applicant entered the Regular Air Force and on 31 August 2014, he retired and was credited with 22 years and 21 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility, which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial of the applicant’s request for the GWOT-E w/1BOLC. The GWOT-E medal is awarded to service members who have deployed abroad to specific geographic areas of eligibility in support of GWOT operations on or after 11 September 2001, to a future date to be determined. Service members must have been permanently assigned, attached, or detailed to a unit that participated in designated operations in the specified area of eligibility for 30 consecutive days or 60 nonconsecutive days or were engaged in actual combat against the enemy and under circumstances involving grave danger of death or serious bodily injury from enemy action, regardless of time in the area of eligibility or while participating in the designated operation, regardless of time in the area of eligibility, was killed, wounded, or injured requiring medical evacuation from the area of eligibility. Although the applicant was deployed twice under circumstances that warranted award of the GWOT-E medal, the medal may only be awarded once. Bronze oak leaf clusters are not authorized; therefore, the applicant's DD Form 214 correctly reflects the GWOT-E medal. DPSID was able to verify the applicant is entitled to the GWOT-E medal. However, individuals are only presented a GWOT-E medal upon initial award. No battle stars have been prescribed. The Oak Leaf Cluster is not an authorized device for the GWOT-E medal. To grant relief would be contrary to the criteria established by DoD Manual 1348.33, Manual of Military Decorations and Awards, Secretary of the Air Force, Chief of Staff, and/or the War Department. DPSID was also able to verify the applicant's entitlement to the MSM w/3BOLCs and the AFESR w/GB and 1BOLC and the Air Force Good Conduct Medal with one Silver Oak Leaf Cluster and 1/BOLC. Upon the final Board decision, administrative correction of the applicant's official military personnel record will be completed by AFPC/DPSOR. A complete copy of the DPSID evaluation, with attachment, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: On 9 March 2015, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit D). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force OPR and adopt the rationale expressed as the basis for our conclusion that relief beyond that already granted administratively is not warranted. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
