RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04543 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records receive reconsideration for an additional 10% of retirement pay based on the award of the Airman’s Medal (AmnM). APPLICANT CONTENDS THAT: According to AFI 36-2803, Air Force Military Awards and Decorations, the Special Order of a decoration approved for gallantry or heroism should include the following statement in the heading of the order: “The approved member(s) for the award of the (name of the decoration approved for heroism) has been considered and approved/disapproved for an additional 10% for retirement purposes not to exceed 75%, in accordance by the decoration approval authority, the Secretary of the Air Force Personnel Council and AFI 36-2803, paragraph 1.6.1. This decoration is effective upon the date of service indicated. PAS: .” This statement is missing on the Special Order which awarded his AmnM. Based on this omission he believes he was not considered for the retired pay percentage increase. In support of his request, the applicant provided a copy of his AmnM Special Order and Citation. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 15 Feb 95. On 10 Sep 07, the applicant was awarded the AmnM for heroism involving voluntary risk of life on 3 Dec 06. On 28 Feb 15, the applicant retired from active duty and was credited with 20 years and 16 days of active service. The remaining relevant facts pertaining to this application are contained in the memorandums prepared by the Air Force offices of primary responsibility (OPR), which are attached at Exhibits C and D. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. In accordance with AFI 36-3203, Service Retirements, dated 8 Sep 06: since 1979, enlisted members who have been awarded the Silver Star, the Distinguished Flying Cross for heroism in a noncombat action, or the AmnM have been automatically considered for the additional 10% retired pay increase. If they were approved for the additional 10% increase in retirement pay, their Special Orders approving the decoration will include a statement to that fact. Absence of the statement may indicate that it was not approved by the Secretary of the Air Force Personnel Council. If the member believes consideration was not made at the time the medal was awarded, the member may ask for a Secretarial decision. In accordance with AFI 36-2803, dated 18 Dec 13, For High-Level Decorations: decorations associated with this process are decorations approved for gallantry or heroism, and may be considered for an additional 10% for retirement pay purposes for enlisted personal upon approval by the approval authority. The decorations are the Medal of Honor, the Air Force Cross, the Silver Star, the Distinguished Flying Cross with Valor, and the Airman’s Medal. The Special Order created for the decoration approved for gallantry or heroism for enlisted personnel should also include the following statement in the heading of the order: “The approved member(s) for the award of the (name of the decoration approved for heroism) has been considered and approved/disapproved for an additional 10% for retirement purposes not to exceed 75%, in accordance by the decoration approval authority, the Secretary of the Air Force Personnel Council, and AFI 36-2803, paragraph 1.6.1. This decoration is effective upon the date of service indicated. PAS: .” The basis for the applicant’s request is that there is no statement on his Special Order indicating the 10% increase in retirement pay had been considered at the time the decoration was approved. According to the original AmnM recommendation package, the Air Force Decorations Board did consider the applicant for the additional 10% increase in retirement pay; however, it was ultimately determined the applicant’s actions did not rise to the level required for the additional 10%. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. SAFPC-Decs recommends denial indicating there is no evidence of an error or an injustice. The applicant was considered and not approved for the additional 10% in retired pay. A complete copy of the SAFPC-Decs evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 29 May 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility (OPR) and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
