RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04632 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be corrected to add the following awards and medals: 1. Basic Aircrew Member Badge (Administratively Resolved). 2. Air Medal with two Bronze Oak Leaf Clusters (AM w/2BOLCs). 3. Survival Course S-V83A (Administratively Resolved). 4. Three (3) Letters of Accomplishments (LOAs). APPLICANT CONTENDS THAT: These awards and medals are missing from his records. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant initially entered the Regular Air Force on 5 Jan 66. On 18 Dec 69, the applicant was furnished an honorable discharge, and was credited with 3 years, 11 months, and 14 days of active service. On 12 Mar 14, AFPC/DPSOR administratively corrected the applicant’s records to reflect completion of the Survival Course S-V83A and was awarded the Basic Aircrew Member Badge. In accordance with AFI 36-3202, Separation Documents, List all decorations, unit awards, badges, and service awards for all periods of service up to the effective date of the DD Form 214. The governing directive does not allow the listing of letters of accomplishments (LOAs) to the DD Form 214. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSID recommends denial indicating there is no evidence of an error or an injustice. The Air medal may be awarded to any person who, while serving in an capacity with the United States Armed Forces, subsequent to 8 Sep 39, who distinguishes himself or herself by meritorious achievement while participating in an aerial flight. The AM may be awarded for combat or non-combat action in recognition of single acts of valor, heroism, or merit while participating in aerial flight. Additionally, it may be conferred for sustained meritorious achievement (distinction) in the performance of duties involving aerial flight. Although the applicant provided a citation stating First and Second Oak Leaf Cluster for aerial flight with the 6990th Security Squadron, United States Air Force Security Service for inclusive period from 17 Feb 69 to 7 Oct 69, DPSID was unable to locate a Special Order, signed certificate, or any other official documentation verifying the applicant was awarded the AM w/2BOLCs. A complete copy of the AFPC/DPSID evaluation is at Exhibit C. SAF/MRBP recommends denial of the AM w/2BOLCs, indicating there is no evidence of an error or an injustice. The applicant’s DD Form 214 reflects the award of the basic AM, for service 21 Oct 68 to 13 Feb 69. He has provided a citation for the subsequent AMs for the period 17 Feb 69 to 7 Oct 69, but neither the applicant nor AFPC/DPSID could find special orders to accompany them. The special orders are the official verification of an approved decoration. A complete copy of the SAF/MRBP evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 2 Apr 15 for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice warranting correction of the applicant’s records to reflect award of the Air Medal with two Bronze Oak Leaf Clusters (AM w/2BOLCs) or letters of accomplishments (LOAs). We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility (OPR) and adopt their rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice with respect to the (AM w/2BOLCs). As for his request for the addition of LOAs to his DD Form 214, in view of the fact that Air Force governing directives do not allow for the listing of LOAs on separation documents, no action by this Board is required. We note the Air Force OPR has determined the applicant’s eligibility for the Basic Aircrew Member Badge and the Survival Course S-V83A, and will correct his records administratively. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting any relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
