RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04649 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, or his discharge order from the Air Force Reserve (AFR) be amended to reflect he served in Vietnam. APPLICANT CONTENDS THAT: He has no documentation to indicate his Vietnam service. The Department of Veterans Affairs (DVA) recognizes his Vietnam service and he receives compensation for Agent Orange and other issues. He requires the correction to his records in order to join the Veterans of Foreign Wars (VFW). The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 24 April 1956, the applicant entered the Regular Air Force and was released from active duty on 23 January 1959. According to DD Form 220, Active Duty Report, the applicant served on active duty from 6 September 1964 to 20 September 1964. According to a letter from the Detachment 3, 2223d Instructor Squadron Commander dated 8 March 1965; the applicant was awarded the Armed Forces Expeditionary Medal (AFEM) for duties performed in the area of operation of Saigon, South Vietnam from 12 September 1964 to 13 September 1964, during his active duty tour from 6 September to 20 September 1964. According to Reserve Order, EK 3677 dated 26 September 1972; the applicant was released from the Inactive Status List Reserve Section (ISLRS) effective 1 October 1972 and placed on the Retired Reserve list effective 2 October 1972. In a letter dated 13 August 2015, AFPC/DPAPP advised the applicant they were able to verify and confirm Boots on Ground (BOG) foreign service time in Vietnam from 12 September 1964 to 13 September 1964, for two days. Since specific locations are not annotated on a DD Form 214, the applicant was advised to use the letter as proof of his BOG service in Vietnam. AIR FORCE EVALUATION: AFPC/DPAPP recommends denial. A review of his master personnel records and documentation submitted failed to substantiate foreign service time in Vietnam. A complete copy of the AFPC/DPAPP evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: As a Reserve officer, he served from 1962 to 1969 at Hamilton AFB, California. He devoted three or four weeks a year to active duty service, flying out of McClellan AFB, California. On these flights, he was assigned to crews flying to Japan, Philippines, Vietnam and all over the Pacific Rim. He can produce additional information to prove his additional service in the AFR. His medical records indicate his service time in Vietnam. The applicant’s complete submission is at Exhibit E. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice to warrant amending his DD Form 214 to reflect Vietnam service. We note the Air Force Office of Primary Responsibility (OPR) initially recommended denial of the applicant’s request indicating there is no evidence to substantiate the applicant served in Vietnam. However, after reviewing the letter dated 8 March 1965, awarding the applicant the AFEM for duties performed in Vietnam, DPAPP provided the applicant a BOG letter as proof of his service in Vietnam. The applicant was also advised that specific locations are not annotated on a DD Form 214; therefore, we find no basis to amend his DD Form 214 as requested. Therefore, aside from the BOG letter, we find no basis to recommend granting the additional relief sought in this application. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
