RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04733 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1. His duty history be properly updated to reflect the correct Air Force Specialty Code (AFSC), organizational level, and duty title (administratively corrected). 2. His Officer Performance Report (OPR) rendered for the period of 1 Mar 08 through 30 Apr 09, be changed to correctly document receipt of the ACC Air Force Chief of Safety Aircrew of Distinction Award for 2008. 3. His PRF for Board PO514A be changed to correctly document the same award and a new Office Selection Brief (OSB) be generated and he be granted a Special Selection Board promotion consideration for PO514A (administratively corrected). APPLICANT CONTENDS THAT: This error was discovered upon comparison to another officer’s duty history to whom he was providing mentoring and during his non-select counseling feedback question. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant is currently serving in the grade of Major (O-4) in the Regular Air Force. The remaining relevant facts pertaining to this application are contained in the memoranda prepared by the Air Force offices of primary responsibility (OPR), which are attached at Exhibits C and D. AIR FORCE EVALUATION: AFPC/DPSIDE recommends denial indicating there is no evidence of an error or an injustice. The applicant has not exhausted all available avenues of administrative relief prior to seeking correction of their military records. If the administrative appeal is not successful, the applicant may resubmit the DD Form 149, Application for Correction of Military Records, and the results of the ERAB administrative review, to SAF/MRBR, 550 C Street West Suite 40, JBSA-Randolph TX 78150-4742 for processing to the AFBCMR. Under the provisions of AFI 36-2603, Air Force Board for Correction of Military Records, the request for correction of military records, DD Form 149, Application for Correction of Military Records Under the Provisions of Title 10, USC, Section 1552, has been examined at this Center. Air Force Board for Correction of Military Records (AFBCMR) is the highest level of administrative appeal within the Department of the Air Force. The AFBCMR will not consider a case until all avenues of administrative relief have been exhausted. They recommend the applicant submit a new AF Form 948, Application for Correction/Removal of Evaluation Reports, with all required supporting documentation, through the virtual military personnel flight (vMPF)/Evaluation Appeals found under the Most Popular Applications. In Accordance With AFI 36-2401, Correcting Officer and Enlisted Evaluation Reports, paragraph 1.3, it states: “Prohibited Requests - The Board will not consider nor approve requests to: 1.3.6. Change an evaluator’s ratings or comments.” Furthermore, paragraph Al.5.22, states: Al.5.22. “Re- accomplishing an Evaluation Report: If you are requesting a report be reaccomplished, you must furnish a substitute report in your appeal case.” The substitute report must: Al.5.22.1. “Be signed by the evaluators who signed the original report (this includes the commander on EPRs).” In addition, the applicant must include supporting memorandums from the original rating officials who signed the original report to justify/explain the change(s) made to the contested OPR. Paragraph Al.3, it states: “Statements from the rating chain should cite important facts or circumstances that were unknown when the evaluators signed the report; Detail the error or injustice; Explain how and when it was discovered; Include the correct information; Relate to the contested reporting period; Address the allegations and substantially challenge or disprove comments or ratings in the report.” A complete copy of the AFPC/DPSIDE evaluation is at Exhibit C. AFPC/DPSOO recommends denial indicating there is no evidence of an error or an injustice with regard for SSB consideration with inclusion of a corrected OPR. Their evaluation of the applicant's request to update his 30 Apr 09 OPR requires them to rely on the opinions of other Air Force experts. HQ AFPC/DPSIDE, Evaluation Appeals, provided a memorandum recommending the applicant submit an AF Form 948, Application for Correction/Removal of Evaluation Reports, with all required supporting documentation, through the vMPF/Evaluation Appeals found under the Most Popular Applications, thereby exhausting all his administrative avenues of relief. If the administrative appeal is not successful, then the applicant can resubmit a DD Form 149. The applicant requests corrections to the Assignment History Section on his P0514A Officer Selection Brief and to his Officer Performance Report (OPR) closing 30 Apr 09. The Chief, Officer Promotions and Selective Continuation Branch, HQ AFPC/DPSOO, administratively approved correcting duty title entries effective 20 Jul 12, 1 Aug 11, and 30 Sep 05 on the applicant's OSB and granted SSB consideration by the CY14A (3 Mar 14) (P0514A) Lieutenant Colonel Central Selection Board (CSB). After the applicant submitted his application, he submitted an amendment to withdraw his request regarding duty title entries 1 Mar 07, 1 Mar 06, 16 Nov 00, and 31 May 00. As such, this advisory will only address the OPR issue and further SSB consideration. The applicant has one nonselection to the grade of lieutenant colonel by the CY14A (3 Mar 14) (P0514A) Lieutenant Colonel CSB. The governing directive is AFI 36-2501, Officer Promotions and Selective Continuation, dated 16 Jul 04. A complete copy of the AFPC/DPSOO evaluation is at Exhibit D. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: Copies of the Air Force evaluations were forwarded to the applicant on 1 Jul 15, for review and comment within 30 days (Exhibit E). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has not exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. In this respect, we note this Board is the highest administrative level of appeal within the Air Force. As such, an applicant must first exhaust all available avenues of administrative relief provided by existing law or regulations prior to seeking relief before this Board, as required by the governing Air Force Instruction. The Air Force office of primary responsibility has reviewed this application and indicated there is an available avenue of administrative relief the applicant has not first pursued. In view of this, we find this application is not ripe for adjudication at this level as there exists a subordinate level of appeal that has not first been depleted. Therefore, in view of the above, we find no basis to recommend granting the relief sought in this application except that in which was previously granted administratively. THE BOARD DETERMINES THAT: The applicant be notified that all available avenues of administrative relief have not been exhausted; and the application will only be reconsidered upon submission of documentary evidence indicating that said avenues of administrative relief have been exhausted.
