RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04744 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His records be corrected to reflect award of the Air Force Achievement Medal (AFAM) (administrativly resolved), Air Force Combat Action Medal (AFCAM) and the Nuclear Deterrence Operations Service Medal. APPLICANT CONTENDS THAT: The AFAM was never added to his DD Form 214. The AFCAM was not established until 2007, but is retroactive to 11 Sep 01. The Nuclear Deterrence Operations Service Medal was established in 2014 and is retroactively awarded for participating in or directly supporting nuclear deterrence operations after 26 Dec 91. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant served on active duty from 16 Dec 03 to 15 Dec 09, and was credited with six years of active service. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: AFPC/DPSOR recommends denial for award of the AFCAM and Nuclear Deterrence Operations Service Medal indicating there is no evidence of an error or an injustice. There was no documentation provided or located to substantiate the applicant’s request for the AFCAM. To reasonably consider his request for the AFCAM he will need to provide a detailed account of the circumstances submitted preferably by someone with firsthand knowledge of the incident. The account must contain details on how he was in grave danger. In addition, supporting documentation such as contingency, exercise, deployment orders, finalized travel vouchers, decorations, or letters of evaluation can be submitted with the detailed account. The AFCAM was established to recognize Air Force military members, from 11 Sep 01 to a date to be determined, who actively participated in air or ground combat within a designated combat zone in combat conditions. To qualify for the award, an individual must have come under direct and hostile fire while operating in unsecured space outside the defended perimeter or, if inside a defended perimeter, served in a defensive capacity. Service members who have previously received the Army Combat Infantry Badge, Army Combat Action Badge, Army Combat Medical Badge, or Navy Combat Action Ribbon while assigned to a sister service unit may submit a copy of the award, along with other documentation, to the appropriate chain of command for consideration of the AFCAM. The Nuclear Deterrence Operations Service Medal was established on 27 May 14, and is retroactive to 27 Dec 91. Service members are awarded the Nuclear Deterrence Operations Service Medal who, while assigned, attached, deployed, or mobilized to a unit, provided support to the Nuclear Enterprise for 120 consecutive or 179 nonconsecutive days, and the unit was subjected to a Nuclear Inspection or performed duties in nuclear operations to include nuclear weapon storage facilities, nuclear command, control, and communications, cyber surety, security, safety, transportation, maintenance, facility management and maintenance, explosive ordnance disposal, aircrew certified for support to nuclear operations, weapons loaders, warning and attack assessment, personnel reliability program management, or research, development and acquisition of nuclear systems. Service members must have served honorably to receive the Nuclear Deterrence Operations Service Medal. The applicant’s entitlement to the Nuclear Deterrence Operations Service Medal or the AFCAM could not be verified. The applicant’s entitlement to the AFAM has been verified and his records will be administratively corrected to reflect award of the AFAM. A complete copy of the AFPC/DPSOR evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 9 Jul 15, for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was not timely filed. While the applicant claims a date of discovery of less than three years ago, in our view, the reasonable date of discovery of the alleged error or injustice was more than three years ago. 3. Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force OPR and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. There was insufficient evidence provided to show the applicant met the criteria for award of the AFCAM and the Nuclear Deterrence Operations Service Medal. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting relief beyond that rendered administratively. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
