RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-04829 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: 1.  Her DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to reflect her removal from the Temporary Duty Retired List (TDRL) and placement on permanent retirement with a compensable disability rating of 30 percent. 2.  Block 13 of her DD Form 214 reflect she was awarded the NATO Medal. (Administratively corrected) APPLICANT CONTENDS THAT: Her status recently changed from being on the TDRL to being permanently medically retired. In addition, the NATO Medal is missing from her DD Form 214. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: The applicant served in the New Jersey Air National Guard (NJ ANG) during the period of time under review. Under Special Order ACD-01103, dated 9 Feb 11, the applicant was relieved from active duty as of 26 Apr 11; was placed on the TDRL with a compensable percentage for physical disability of 30 percent, effective 27 Apr 11; and, was credited with 8 years, 3 months, and 18 days of total active service. Under Special Order ACD-01018, dated 14 Jan 13, the applicant was removed from the TDRL and retired with a compensable percentage of 30 percent for physical disability, effective 3 Feb 13. On 30 Nov 11, ARPC/DPTS directed the applicant’s DD Form 214 be corrected to add the NATO Medal to Block 13, and the statement “Member served in support of Operation Enduring Freedom IAW 10, USC 12301(H) from 30 May 08 to 26 Apr 11. Period of service under Title 10 USC 12301(H) is exempt from 5 year cumulative service under Title 38 USC Chapter 43, Section (c)(4)(B)” to Block 14. The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C. AIR FORCE EVALUATION: ARPC/DPTS recommends denial indicating there is no evidence of an error or an injustice. Per AFI 36-3202, Separation Documents, if a member is being separated because of removal from the TDRL, then a new DD Form 214 is not issued. To approve the applicant’s request to issue a new DD Form 214 would be contrary to Department of Defense and Air Force guidance. However, ARPC/DPTS was able to administratively correct her DD Form 214 to add the NATO Medal to Block 13, and correct Block 18 to say “Member served in support of Operation Enduring Freedom IAW 10, USC 12301(H) from 30 May 08 to 26 Apr 11. Period of service under Title 10 USC 12301(H) is exempt from 5 year cumulative service under Title 38 USC Chapter 43, Section (c)(4)(B).” A complete copy of the ARPC/DPTS evaluation, with attachments, is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 26 Feb 15 for review and comment within 30 days (Exhibit D). As of this date, no response has been received by this office. THE BOARD CONCLUDES THAT: 1.  The applicant has exhausted all remedies provided by existing law or regulations. 2.  The application was timely filed. 3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of ARPC/DPTS and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the requested relief beyond that which was administratively corrected. THE BOARD DETERMINES THAT: The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
